DECISION
Before the Commission for resolution are the original and amended applications
filed on November 6 and 20, 2009, respectively, by the Tarlac Il Electric Cooperative,
Inc. (TARELCO I!) for approval of an adjustment in rates under the Rules for Setting the
Electric Cooperatives’ Wheeling Rates (RSEC-WR), with prayer for provisional
authority.
Having found said applications sufficient in form and in substance with the
required fees having been paid, an Order and a Notice of Public Hearing, both dated
January 11, 2010, were issued setting the same for jurisdictional hearing on February 9,
2010. In the same Order, the Commission provisionally authorized TARELCO II to

TARELCO II was directed to cause the publication of the Notice of Public
Hearing, at its own expense, twice (2x) for two (2) successive weeks in two (2)
newspapers of general circulation in the Philippines, with the date of the last publication
to be made not later than ten (10) days before the date of the scheduled initial hearing,
It was also directed to inform the consumers within its franchise area, by any other
‘means available and appropriate, of the filing of the instant applications, its reasons
therefor and of the scheduled hearing thereon.
The Office of the Solicitor General (OSG), the Commission on Audit (COA) and
the Committees on Energy of both Houses of Congress were furnished with copies of
the Order and the attached Notice of Public Hearing and were requested to have their
respective duly authorized representatives present at the aforesaid hearing.
Likewise, the Office of the Provincial Governor of Tarlac and the Offices of the
Mayors of the Municipalities within TARELCO II's franchise area were furnished with
copies of the Order and the Notice of Public Hearing, for the appropriate posting thereof
on their respective bulletin boards.
During the February 9, 2010 hearing, only TARELCO II appeared. No
intervenor/oppositor appeared. It presented its proofs of compliance with the
Publication and posting of notice requirements of the Commission which were duly
marked as Exhibits “A” to “P-3", inclusive, and conducted an expository presentation of
its application. The Commission noted the “Pre-Trial Brief” and "Manifestation (On the
Proposed Recovery Scheme of the Provisionally approved RSEC-WR Rate Adjustment
of January 2010)" filed by TARELCO II on February 2, 2010 and March 15, 2010,

In view of the absence of intervenors/oppositors, TARELCO II moved for a
declaration of general default. Said motion was granted.
On August 31, 2010, the Commission issued an Order setting the instant
applications for evidentiary hearing on September 14, 2010.
At the September 14, 2010 hearing, TARELCO II presented its witnesses, Ms.
Rosemarie T. Timbol, its Finance Services Department (FSD) Manager and Ms. Alona
Z. David, its Information Technology Department (ITD), who testified on the following: 1)
the filing of the instant applications; 2) the identification of the pre-filing and jurisdictional
requirements of the Commission; 3) the new rate setting methodology of RSEC-WR; 4)
the proposed initial rate caps for Distribution, Supply and Metering (DSM); 5) the
Members’ Contribution for Capital Expenditure (MCC); and 6) the proposed transition
rates. In the course thereof, TARELCO II presented additional documents which were
duly marked as exhibits,
‘The direct examinations having been terminated, the Commission propounded
clarificatory questions on the said witnesses. Thereafter, TARELCO II was directed to
file its formal offer of evidence.
On September 30, 2010, TARELCO II filed its "Formal Offer of Evidence” which

DISCUSSION
On September 23, 2009, the Commission promulgated Resolution No. 20, Series
of 2009, entitled “A Resolution Adopting the Rules for Setting the Electric Cooperatives’
Wheeling Rates (RSEC-WR)”. The Commission deems it necessary to establish a new
rate-setting methodology for on-grid electric cooperatives (ECs) considering that their
current rates, under a cash flow rate-setting methodology, are no longer responsive
inasmuch as the costs of providing electric service to the consumers increased
significantly from the time their rates were determined by the Commission based on
2000 test year, The regulatory framework as embodied in the RSEC-WR seeks to
encourage efficiency in the operations of the ECs, to provide incentives for their good
performance and to ease regulatory burden by addressing the regulatory lag in the cash
flow rate-setting methodology.
|. Classification of Electric Cooperatives (ECs)
The RSEC-WR classified the on-grid ECs into seven (7) groups based on
characteristics or variables which affects the ECs’ total operating distribution cost and
operating distribution cost per kWh, namely: 1) size (number of customers); and 2)
consumption (MWH sales per customer). In classifying the ECs, the Commission used
the data submitted by the ECs relative to their respective operating distribution costs
(Operations and Maintenance Expenses, Customer Expenses and General and
Administrative Expenses) for the years 2001 to 2006 and the average adjusted
unbundled rates (Reinvestment Fund and Debt Service).

TARELCO II's consumption per year (MWH sales per customer) is 1.8742 MWH
and the number of its customers is 58,006. Inasmuch as TARELCO II's consumption is
between 1 to 2 MWH and the number of its customers is within the range of 50,000 to
100,000, it is categorized as Group E.
Il, Development of the Initial Tariff
Under the RSEC-WR, there shall be transition from the current tariff under the
cash flow rate-setting methodology towards the Initial Tariff. Such Initial Tariff consists
of the DSM Charges (operating cost) and MCC (capital cost),
Operating Cost
The operating cost per kWh as of 2000 for DSM of each EC was adjusted to
2008 level using the average rate of increase in minimum wages for the period 2001 to
2006 of 5.12%. The wage index was used since the DSM cost is seventy percent
(70%) labor. Thereafter, the Commission determined the 2008 Median for the EC’s

Members’ Contribution for Capital Expenditure (MCC)
The EC's current tariff as approved by the Commission includes a reinvestment
fund provision calculated at five percent (5%) of its unbundled retail rate (inclusive of
generation, transmission, and distribution charges). This translates to an average of
twenty-two percent (22%) of the ninety-eight (98) ECs’ operation and maintenance
expense for 2006. The MCC Rate Cap was determined by applying the twenty-two
Percent (22%) to the respective group's 2008 Median operating costs per kWh which
was the basis for the ECs’ operating revenue requirements (ORR).

The ORR (operating cost) per group was functionalized (assigned to DSM
functions) using the ratio of each group's DSM costs to the total costs as determined in.
the Rate Unbundling Decision. The functionalized ORR was allocated into customer
classes using a factor based on the causation principle. The allocation factors utilized
were the group’s Non-Coincident Peak (NCP) Demand Ratio for Distribution and the

Average Number of Customers Ratio for Supply and Metering. The allocated
functionalized ORR of each customer class was translated into DSM rate caps.
Ill, Development of New Customer Classes
The new customer classes under the RSEC-WR are based on the power service
delivery voltage used in serving the customers. The Commission found the new
‘customer segmentation as fair and reasonable as it allows a justifiable allocation of
costs and is consistent with cost of service principle. Shown below are the new
customer classes:

TARELCO II proposed a full implementation of its DSM rates towards the Initial
Tariff and its MCC rate to provide it with the necessary funds for its CAPEX projects.
V. Provisional Authority
Finding the instant applications to be consistent with the RSEC-WR and that the
proposed rates are just and reasonable based on the documents submitted, the
Commission issued an Order dated January 11, 2010 provisionally authorizing
TARELCO II to implement the aforementioned Revised Rate Schedule effective its
January 2010 billing period
VI. The Final Transition Rates Schedule
In the Commission's Order dated January 11, 2010, TARELCO II was directed to
adopt the provisionally-approved Revised Rate Schedule starting its January 2010
billing period. TARELCO II received the said Order on January 28, 2010 and was able
to implement it on its February 2010 billing period.
Relative thereto, the Commission calculated the differential billing of TARELCO II
and arrived at a net amount of PhP4,611,450,00 to be collected from its end-users
starting April 2011 to December 2011. Said amount corresponds to the difference
between its existing rates and the transition rates for January 2010 billing which is
equivalent to an average rate of PhP0.0538/kWh. The adjustment in rates will be
incorporated at the end of Year 1 transition rates under the line item "Distribution Charge
& MCC Charges” (both expressed in PhP/kWh),

A thorough review and evaluation of the instant applications showed that the
implementation of the Final Transition Rates Schedule, as shown below, will benefit
TARELCO II's consumers in terms of a more reliable, efficient and quality electric
