Sir, Ithas come tothe notice &f Council, that you have established a Firm by the Name “YMS Associates” and carrying on the profession of an Architect. Upon verification from the Register of Architects, it is noticed that you (Shri Yomesh N:Rao) is not registered as an Architect under the-Architects Act, 1972 with Council of Architecture. Thus, you/your firrn are misrepresenting as an Architect to solicit Architectural work on your Letterheads, website and other places. In case you are registered, please mention your Registration No. with Council of Architecture. 1n this reigard, it is informed that under the provisione of Architects Act, 1972, enacted by Parliament of India namely Sections 2(a), 35, 36 end 37 of the Act, only an individual Architect or partnership firm consisting, of ali architect partners set up under’ Partnership Act, 1932 can use the tte and ‘style of Architect and/or represent as an Architect for carrying on the profession of an Architect in India, Architects cannot practice the profession of an Architect throug’ Company or LLP. Violation of the provisions of the Act is a cognizable offence whicivallracts punishment under the law. You are, therefore, directed to immediately stop working/representing as an Architect and remove the word “Architect” from any drawing, plan, document, .visiting Card, website/e-advertisement ‘etc. for soliciting architectural work. ° Further, you are directed to show cause why a complaint be not filed against you/your company under the Provisions as provided under Section 39 of the Architects Act,.1972 for violating the Section 36 and 37 of the Architects Act, 1972.
