ALCANTARA ‘SB Member/SK President ‘SB Member/ABC President oe 58 Member ORDINANCE NO. 2013-020 DOG PROTECTION AND RABIES PROTECTION AND CONTROL ORDINANCE OF THE MUNICIPALITY OF CAINTA, RIZAL Sponsored by the SB Committee on Agriculture chaired by Councilor Allan G. Tajuna WHEREAS, the Sanggunian Bayan determined that a new, comprehensive and reasonable ordinance relating to astray animals be adopted to reasonably protect the public health and safety and promote the general welfare of the inhabitants of Cainta, Rizal; and Section 489 (b) (3) (iv) of Republic Act No. 7160, otherwise known as The Local Government Code of 1991, grants power to the Municipal Veterinarian, “to take the necessary measures to eradicate, prevent or cure all forms of animal diseases”, for the consideration of the Sangguniang Bayan; WHEREAS, record from the Cainta Health Office Animal Bite Treatment Center (ABTC) says, that for the past three years there were around 1,892 cases of animal bites mostly of dog bites; WHEREAS, this ordinance intends to discourage stray and abandoned dogs while also protecting ‘the health and safety of the inhabitants from the continuing growth of rabies incidence within our municipality; WHEREAS, Section 2 of R.A. 9482 “Anti Rabies Act of 2007” declares the policy of the state to protect and promote the right to health of the people through a system of control, prevention of the spread, and eventual eradication of human animal rabies, providing for the need for Responsible Ownership, NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED BY THE SANGGUNIANG BAYAN, in session duly assembled that: Page 2 Ordinance No. 2013-020 DEFINITION OF TERMS: Animal ~a dog/puppy or cat/kitten Bitch{es) ~2 sexually mature female dog (Pregnant or already gave birth) ‘Animal Control Officer ~ Municipal Veterinarian under the supervision of Municipal Agriculture Officer Animal Control Personnel - those persons under the supervision of Animal Control Officer assigned to conduct the handling, impoundment and apprehending of unregistered/registered dog at large. Registering Authority ~ Municipal Agricultural Officer Veterinarian — veterinarians accredited by the Cainta Health Office Animal Bite Treatment Center, Municipal Veterinarian. ‘Owner - any person keeping, harbouring or having charge, care or control of a Dog including his/her representative. Altered Animal ~ 2 dog that has been sui female, “neutered” for a male. lly rendered incapable of reproduction. (“spayed” for a Dog - refers to a common quadrupled domestic animal belonging to the order Carnivora (male or female), scientifically known as canis familiaris Dog at large- means any dog off the premises of its owner or the premises of another person charged with the care of the dog, and not under immediate control of its owner or authorized agent of the owner, elther by, a) leach or teether, lead or other physical control device, b) voice restraint or signal control of a person capable of controlling, subduing or restraining the dog Vicious Dog - means any dog, without provocation, bites, attempts to bite, harasses, or chases away human or animal. Stray Dog — any Dog leaving its Owner's place or premise and no longer under the effective control of the Owner. Surrendered dog - unwanted dog by the owner for what ever reason that are handed over to the animal control personnel. Bite - means a wound, bruise, laceration or puncture infected on a person or animal by the teeth of the dog. Leash - means any flexible lead, including nylon leashes, cords, rope, light chains or other similar device of suitable strength to restrain or control a dog to which attacked Rabies - refers to a highly fatal disease caused by a Lyssa virus transmitted mainly through the bite of fan infected animal and is characterized by muscle paralysis, hydrophobia, aerophobia and other neurological manifestation. Rabies Vaccination - inoculation of an animal without rabies vaccine administered under the supervision of a licensed veterinarian. Impound - means the taking of a dog into the custody of a facility designated by the Municipal Agricultural Office. Dog Tag - A durable metal or plastic tag, distinguishable from each other as serially numbered and or coded issued solely by the Municipal Agriculture Office through the vaccinator/s. Page 3 Ordinance No. 2013-020 Registration Fee - refer to the legal cost of registration that may impose against dog owners as a result of the compulsory registration of all domesticated dogs. Section 1. Duty - It shall be the duty of owner of any dog or anyone having any of dog in his/her possession to exercise reasonable care and to take all necessary steps and precaution to protect other people, their property and animals from injuries or damage that might result from such dog’s behavior. Section 2 - Responsibilities and Liabilities of the Owner: a) It shall be the obligation of every pet owner to submit all pet animals under his/her charge to an accredited veterinarian of his/her own choice for periodic vaccination. b)_ It shall be the obligation of every pet owner to prevent all pet animals from defecating on any public or private property other than his own or shall immediately collect and properly dispose of all fecal matter deposited by the animal while itis off his property. ©) It shall be the obligation of any pet owner not to harbor or maintain any vicious dog unless the dog is secured in one of the following ways: 1) The dog is securely and adequately confined upon the property of the owner or other person having charge, care or control of such dog so as not to injure any person or damage any property, or be a hazard to public health and safety 2). The dog is properly restrained and leashed on a line not to exceed six feet (6) in length, properly muzzled and under the immediate control of a person of suitable age and capacity to subdue, control and restraint such dog, 3) It shall be the obligation of the owner not to allow their pet animal to be at large d} In the case of a pet animal causing damage to property, the registered owner shall indemnity the total cost of damage to property. €) In the case of @ pet animal causing injury to other persons, the injured victim shall be entitled to receive from the registered owner such compensation to include the total costs of medical treatment and/or hospitalization as the case maybe, including the costs of ‘specimen examinations whenever such pet animal is suspected to be rabid. (Owner shall not be deemed liable if any of the following applies a) The dog bites, attacks or menaces a person or animal that: 1) assaults the owner 2) trespasses on the property of the owner 3) is in the act of tormenting or abusing the dog or its offspring b) The dog is otherwise acting In defense of an attack by a person or other animal upon the owner or other person f) Within 24 hours, report immediately any dog biting incident to the concerned officials for investigation or for any appropriate action and the dog should be place under observation by the municipal veterinarian or accredited veterinarian. Sudden death of any animal should also be reported immediately. ncaa eaeeaacaacaa aaa cmcaa aac Page 4 Ordinance No. 2013-020 Section 3 - Mandatory Rabies Vaccination 2) All dogs over the age of for (3) months must be vaccinated against rabies. ) In the case of mass anti rabies vaccination; dogs of all ages, gender or breed must be vaccinated, including pregnant bitches. <)_ In compliance with the provision of Section 6 (3) of RA9482 Anti Rabies Act of 2007 the LGU through the Municipal Agriculture Office shall undertake free annual anti rabies vaccination of dogs giving priority to high risk depressed areas. ) After vaccinating a dog against rabies, the veterinarian shall sign a certificate of vaccination in duplicate in the form required by the Municipal Agriculture Office. The veterinarian shall keep one copy and shall give one copy to the owner of the vaccinated dog and the owner shall retain that copy in his possession. @) Record of rabies vaccinations shall be kept by all accredited veterinarians administering the rabies vaccines. Section 4 - Registration of Dog 2) All dogs over the age of three (3) months shall be submitted by its owner for registration. b)_No dog shall be kept harboured or maintained within the Municipality of Cainta unless such dog is registered, ©) Rabies vaccination certificate Issued by the accredited veterinarians administering the rabies vaccines must be presented to the registering authority 4) Securing and submission of application form shall be made to registering authority. It shall include the name and address of the owner and the name, breed, color, age, and sex of the animal e) The Municipal Agriculture Office shall maintain a record of all registrations, and such records shall be made available to the Municipal Pound Center and animal control personnel f} A registration certificate shall be issued by the registering authority indicating the permanent registration number. Section 5 - Registration Fee a) The lifetime registration fee shall be in the amount of one hundred pesos pet animal inclusive of the cost of animal tags and registration certificate. b) The refusal or failure of the owner of any dog to register the dog or pay the registration fee shall be deemed abandoned of such dog by the owner. Abandoned dogs shall be subject for impoundment 100.00} pesos per ¢) Senior citizens residents shall be entitled to a 20% discount per pet animal } 50% discount shall be made available for altered animals (spay and neutered) 8) Issuance of Official Receipt ~ The Municipal treasurer shall issue the owner of the dog with an official receipt upon full payment of every vaccinated and registered dog. x Section 6 - Dog Tag a) Upon acceptance of the registration application and appropriate fee, The Municipal Agriculture Office shall issue a certificate and affixed a registration tag to the dog collars, which the animal's ‘owner shall produce upon request from any animal control personnel. b) No improper use of Registration Tags - All Dogs shall be registered with the Municipal (3 Agriculture Offce regardless of whether the dog is vaccinated or nat. No person shall attach a registration tag unless the dog has been properly vaccinated and registered Page 5 Ordinance No. 2013-020 ©) Incase of lost, stolen or damaged registration tag of registered dog, owners shall be required to ‘Submit such animal to the | Office for proper re-tagging within ten (10) days from the day such tag: or damaged. d) All registration tag imposed | ‘fequired to be surrendered back to the Municipal Agriculture Office within ‘death of the animal. Section 7 - impounding =z a) Any stray, viscious and 8 ‘or unregistered) may be impounded by the Animal Control Personnel. if erty t ‘the owner shall be notified not later than three business (3) days after the! | any dog. b) Every dog seized shall be properly fed and cared 2t the expense of the local government until disposition, <)_ The owner of any dog so impounded may reclaim such dog upon payment of the registration fee, if unpaid, and all impounded fees and penalties required under this Ordinance. 4) An impounding fee of five hundred pesos (=P=500.00) shall be paid to the municipality for the first impoundment, an impoundment fee of one thousend pesos ( =P=1,000.00) for the second impoundment and an impounding fee of one thousand five hundred pesos (=P=1,500.00) for each subsequent impoundment in any calendar year. €) Animals that are impounded three times (3x) and not redeemed after three (3) working days shall be subjected to spaying for female and neutering for male and a fee of eight hundred ‘pesos (=P=800.00) shall be collected to cover the cost. 1} All fees shall be paid at the Municipal Treasurer's Office and will issue a receipt for the impounding fee which must be shown to the pound personnel prior to the release of the dog. Section 8 - Disposition of Unclaimed Dogs Unless sooner redeemed by payment, it shall be the duty of the Animal Control Officer to keep all dogs impounded for @ period of five (5) working days. If at the expiration of five (5) working days from the initial date of impoundment, such dog shall not have been redeemed, disposition of animal shall be made as follows: A) Adoption The Animal Control Officer shall assess if the medical condition of the dog is fit for adoption. To utilize this program, any resident must pay one hundred pesos { =P= 100.00) registration fee at the time of the adoption and eight hundred pesos ( =P800.00) for spaying and neutering surgery cost, which entitles the adopter to a free annual vaccination and may be granted a medical extension by the municipal veterinarian. Non residents may adopt @ pound pet and pay a one thousand pesos ( =P=1,000.00) municipal fee, but are not eligible for program benefits. 8) Destroying impounded Dog | Any animal held for the periods prescribed under this Section without redemption or adoption and which is neither a potentially dangerous animal nor in a dangerous condition of health may be disposed of upon the discretion and recommendation of the Animal Control Officer in a F humane manner, animal will be put to sleep permanently through intravenous injection of barbiturates in compliance with Section 6 of RA 8485 otherwise known as Animal Welfare Act of 1998, Section 9 ~ Municipal Rabies Control Committee ) A functional Municipal Rabies Control Committee shall be organized and established and shall f be tasked to strictly and thoroughly incorporate educational awareness activities (re: (A responsible dog ownership, dog registration, vaccination and dog leashing), dog impounding activities, rabies as a fetal and dangerous health problem, others. Page 6 Ordinance No. 2013-020 b)_Holding of orientation seminars and other similar activities for all dogs owners before they have their dog or dogs registered and vaccinated is advised to ensure proper and full comprehension among them of the purpose of this Ordinance, thereby, promoting the ordinance and/or the program's effectivity and sustainability at all levels Composition of Municipal Rabies Control Committee ‘The Municipal Rabies Control Committee shall be composed of the following members, subject to additional membership as the need arises: 1) Chairperson ~ Municipal Mayor 2) Vice Chairpersons ~ Municipal Agricultural Officer, Municipal Veterinarian Municipal Health Officer and Chairperson, SB Committee on Agriculture 3) Members ~ School District Supervisors, Municipal Planning and Development Officer, Two (2) Accredited Non- Government Organization Representatives, Municipal Disaster Risk Reduction and Coordination Officer, President (Federation of Homeowners Association, Municipal PNP Chief, ABC President and Municipal Engineering Officer Section 10 ~ Issuance of Ordinance Violation Receipt (OVR) ) Only the Cainta Animal Control personnel shall issue the OVR o violators of this b) OVR shall be issued to pet owners who violate any of the provision of this Including, but not limited to the following circumstances: < 1. During stray dog operation where stray dog have already caught but escaped, ram back home, or snatched and held back by struggling owner. 2, The dogis tied stationary outside the owner's premises or in public place. 3. The streets are narrow and the impounding vehicle is unable to enter, another person's property or public places. 4. It is strictly prohibited the trading of dog meat. The trade of dogs shall include But shall not be limited to buying and/or selling of dogs, dog meat and carcasses, dog farming, collecting, and/or slaughtering of dogs for commercial consumption. 5. It shall be unlawful for any person to maltreat, kill or torture any animal or subject any dog to dog fights. 6. Pet owners that violate se ©) Procedure of issuance of OVR 1. The stray dog will be followed by the enforcers to know to whom it belongs. if the dog is tied in a public place, the enforcer should find the owner, 2. The OVR will be used to concerned owner after being informed of the violation committed and the corresponding fines. 3. All duplicate copies of the OVR issued will be forwarded to the impounding Office. The violators will only be given three (3) working days to comply. 5. In case of failure to comply, appropriate legal charges will be filed against the owner. on 3,4,5 and 7 of this Ordinance. Section 11 — interference No person shall interfere with, hinder, or molest any Animal Control Personnel in the performance of any duty as provided herein Section 12 - Penalties 7 a) Owners who fail to register as required and specified in Section and 5 will be subject to a fine of two thousand pesos (P=2,000.00). b)_ Failure to perform by the owner Section 3 (e)(f) of this Ordinance will be subject to a fine of ‘two thousand five hundred pesos (P=2,500.00). ©) Anyone interfering with the pound personnel, failing to register an animal after a warning, or violation of any other section of this ordinance is guilty of a misdemeanour and shall be subject toa find not exceeding One Thousand Pesos { P=1,000.00). d) Dog owners shall be penalized with one (1) hour community service each day the animal remains in the impounding area. & lh Page 7 Ordinance No. 2013-020 Section 13 — Disposition of Fines ‘The fines collected using OVR for the violation of this Ordinance shall accrue in favour of the following: a) 70% to the Municipal Government of Cainta b) 30% to fund training of animal control personnel, maintenance and improvement of Municipal dog pound, veterinary service information, education and communication (IEC) campaign. Section 14- Budget There shall be 2 minimum amount of One Million Pesos (=P= 1,000,000.00) for the municipality to be appropriated for the purchase of anti-rabies dog vaccines, assistance to persons bitten by a rabid dog and for the sustainable implementation of this Ordinance. The said amount shall be provided for in the annual budget of the municipality for every calendar year. Section 15 - Repeals (Conflicting Ordinances) All other ordinances of The Municipality of Cainta that are in conflict with this ordinance are hereby repealed to the extent of such cont Section 16 ~ Separability Clause If for any reason of reasons, any part or provisions of this Ordinance shall be held unconstitutional or invalid, other parts of provision hereof which are not affected thereby shall continue to be in full force and effect Section 17 ~ Effectivity This Ordinance shall take effect after its enactment by the Sangguniang Bayan and approval of the Mayor and fifteen days after its posting and publication in a newspaper of local circulation.
