PRELIMINARY STATEMENT

The person examining me is ATTY. ________ with law office address


_____________. My Judicial affidavit is being taken at the above-mentioned
place in the presence of _______ and my companions. The questions are
asked in the English Language but are translated in the Tagalog dialect
which I speak and fully understand, and I am giving my answers fully
conscious that I do so under oath, and I am aware that I may face criminal
liability for false testimony or perjury for false statements made or given by
me.

OFFER OF TESTIMONY

The testimony of the accused is being offered to corroborate and


strengthen the defense of the accused that she was innocent of the crime
charged. This is also being offered to prove that the Moonlight Bar does not
engage in prostitution or any similar activities thereof. He will testify on
what he personally witnessed on the night of the incident.
1. Mr. Witness, will you please tell the Honorable Court your name, age and
other personal circumstances?

Balzain, Tuguegarao City, Cagayan. I am a regular customer at
Moonlight Bar.

2. How do you know the accused?

He is the cashier at Moonlight Bar since the first time I visited the said
bar.

3. How do you describe her personality?

She is very patient and hardworking. She often helps the waiter in
taking orders and even serves food and drinks to the customersl
.

4. When was your first time to visit Moonlight Bar?

Around 2017 when I transferred to the apartment, where I am


currently living few blocks from the Moonlight Bar.

5. How frequent do you visit the Moonlight Bar?

Once a week, Atty. Moonlight Bar has been my favorite place to hang
out with my friends.

6. What services does the Moonlight Bar provides aside from serving food
and beverages?

They also provide karaoke services, Atty.

7. So you are saying that contrary to the allegation of the Prosecution,


Moonlight Bar is not engaging in prostitution and other similar sexual
activities?

Yes, Atty. I am a regular customer and I’ve never seen or noticed


activities involving sexual favors or prostitution being offered in the
establishment.

8. On the night of the incident on March 5, 2020, were you and your friends
at the Moonlight Bar?

Yes, Atty.

9. Have you seen police officers Andres Melad and James Bonifacio on that
same night?

Yes, Atty. Our table is just one table apart from the table of Andres
Melad and James Bonifacio. I’ve seen them ordered from Grace
Tendenilla.
10. Did you immediately identify them as police officers? (Pwedeng pang
cross)
No, Atty. They were not in their uniforms.

11. Did they arrive in the vicinity before you and your friends?

No, Atty. I and my friends were in the Moonlight bar before them.
(Pwede silang mag cross na baka nakainom na si customer kaya hindi na
credible yung mga susunod niyang testimony)

12. What happened next, if any?

I and my friends were busy chatting and drinking when I noticed that
after the conversation of the police officers and Grace, Grace looked
agitated and went outside.

13. And then?

Grace went back to the bar together with two girls and they went
directly to the table where Melad and Bonifacio were seated.

14. Were you able to see if what are they doing? (Objectioanable?)

Yes. They were chatting and drinking.

14. What happened next, if any?

We were disturbed when several police officers came and rushed


towards Grace.

15. What did you do after that?

We just remained on our seats until we heard that the police officers
announced that they were arresting Grace for the crime of Human
Trafficking.

16. Is there anything you want to add more?

None, Sir.
