Herrscher, proved to me through satisfactory evidence of identification, which was personal
knowledge, to be the person whose name is subscribed below and, after having been duly
sworn, deposed and stated as follows:
1. My name is Roger B. Herrscher. I am over the age of eighteen (18) years, of sound
mind, and aun capable of making this affidavit. I have personal knowledge of the
facts stated liere.M and they are true and correct.
2. I am the Se-aior Vice President of Enterprise Products OLPGP, Inc., the sole manager
of HSC PipAinc Partnership, LLC ("Applicant").
3. In my position r;r Applicant, I am familiar with the pipelines that are the subject of the
T-4 applic^ition filed along with this affidavit (the "Pipelines"). Applicant is
requesting that t ^ Pipelines be classified as common carrier pipelines by the Railroad
Commission of Texas ("RRC").
4. Applicant is in the process of installing and constructing the Pipelines for the
transportation of oil products and liquefied minerals, including propylene
(collectively, the "Substances") and Applicant expressly accepts the provisions of
Chapter 11 1 of the Texas Natural Resources Code applicable to common carrier
pipelines whicl, transport any of the Substances, and expressly agrees that, in
consideration of thc rights acquired, Applicant becomes a common carrier subject to
the duties and o;;ligations conferred or imposed by such chapter.
5. The Purpose of the Pipelines is to receive Substances owned by third parties and
received from other pipelines which from time to time may be connected to the
Pipelines and fro:tl which Substances will be received into the Pipelines for transport
for a fee. Al? S!Jbstances entering the Pipelines will be transported within the
Pipelines to one more points of redelivery, which will include plants to which the
Pipelines may ;'mni time to time be connected, for refining, processing or other
processes that convert the Substances into end products such as plastics, medical
supplies, surgici:' components, athletic apparel, plastic bags, plastic cables and cords.
Third part,, sh:pfiers on the Pipelines will retain title to their Substances in the
Pipelines and will, nay Applicant a fee for transportation in such Pipeline.
b. Applicant is familiar with the Landowner's Bill of Rights as published by the Office
of the Attorney General of Texas and the eminent domain provisions of Chapter 21 of
the Texas Property Code. Applicant is entering into a transportation services
agreement with a third party shipper,
7. The Pipeline will benefit the public by providing a means by which the Substances
can be transported within the Pipelines to downstream locations, and ultimately to
end markets, such as refineries and plants and other end users and by providing
transportation of Substances from receipt points into the Pipelines from other
pipelines that may be from time connected to the Pipelines to downstream locations,
and ultimately to cnd markets, such as plants and refineries and other end users.
Residents of the State of Texas will benefit from construction and operation of the
Pipelines, not only through the Pipelines facilitating the transportation of Substances
to plants and refineries where the Substances can be manufactured into useful
products, but also from the various products that result from the manufacturing of the
Substances and tax revenues generated from the transportation revenues, from the
plants and refinerie:, that utilize the Substances in manufacturing processes and from
the sale of the prodthemselves.
8. Applicant has filec'. or will timely file a tariff with the RRC for transportation of
Substances in the ?';pelines, as required by applicable Texas statutes and RRC rules
and regulations.
