SITUATIONAL ANALYSIS

Analyse the situation and advice on Claim Settlement


with respect to Causa Proxima
Situation 1: Mr. Prashant has taken a marine policy to cover the goods exported by him.
Under the policy, goods have been insured against damage likely to be caused by sea water.
During the voyage, a hole was caused at the bottom of the ship. Through this hole, sea
water has entered into the ship and damaged the goods insured. Can Prashant claim for
both Loss to Ship as well as to Goods Insured?

Ans: Prashant can claim only for the goods, not for the ship because in the policy they
insured goods against the damage by sea water.

Situation 2: Due to fire, a wall of a building was damaged and remained standing for several
days. To avert any untoward incident, the municipal authority had ordered it to be
demolished. While undertaking the demolition work, an adjoining building was damaged.
Can the owner of adjoining building claim for loss under Fire Insurance?

Ans: In this case the municipal authority has ordered to be demolish the wall caused by
the fire, so in this situation the owner of adjoining building can claim the losses under the
fire insurance.

Situation 3: In a similar case, a wall of a building was damaged due to fire. Before it could be
demolished or repaired, it fell down due to a storm and it damaged an adjoining building.
The owner of the adjoining building claimed the loss under the fire policy. Can the owner of
adjoining building claim for loss under Fire Insurance?

Ans: In this case damaged wall fall down due to storm, so adjoining building can’t claim
the losses Under the fire policy.

Situation 4: In one case, oranges and lemons were insured as cargo against collision of ship
by Mr. Krishna prasad. Actually, the ship collided and was put into the port for repairs. For
convenience of repairs, the cargo was unloaded on to lighters and reloaded on the ship after
repairs. The fruits when reached destination were destroyed. Can Krishna prasad claim for
losses with Oranges and Lemons?

Ans: In this case there were two situations, one was ship collide another one was delay
due unload and reload, so Krishna prasad can claim only ship collide, not claim losses for
the orange and lemons due to delay.

Situation 5: An insured by name Mr. Shreyas sustained an injury in a motor accident and
was admitted in a hospital. While taking treatment in the hospital, he contracted an
infectious disease which caused his death. Can Shreyas claim for Personal Accident
Insurance?

Ans: In this case Mr. Shreyas can’t claim the personal accident insurance because he died
due to infection deceases, he can claim only for the motor accident.
