PROPOSED GUIDELINES FOR PLEB OPERATIONS

Considering that the City of Makati has been placed under General Community Quarantine
(GCQ) beginning 1 June 2020, the People’s Law Enforcement Board and its Secretariat are proposed
to operate as follows:

I. The Secretariat

1. Pursuant to the memorandum issued by the HR/Personnel Department, the Secretariat


will continue to function at work with a skeleton-staff from 9:00 a.m. to 4:00 p.m.

2. All inquiries on cases and transactions shall be initially coursed and acted upon only
through email addresses and/or Facebook account of PLEB-Makati. Specify email
address and FB account

3. All official meetings, seminars, trainings and other functions in the Secretariat, unless
conducted through videoconferencing, shall be deferred.

II. Procedure for Filing and Issuance of PLEB Clearance

1. No walk-in applications shall be entertained by the Secretariat. All applications for PLEB
Clearance shall be conducted completely online using any of the following platforms:

a. Submission via Google Forms.

a.1. The police officer/applicant shall access the link provided and fill out accordingly
the electronic form; OR

b. Submission via E-mail.

b.1. The police officer, using one’s own e-mail address, shall send an e-mail to the
PLEB Secretariat, stating his or her complete name in the subject line, the
purpose why the clearance is being procured, and contact number.
b.2. Attach in the body image files of the following:
 Accomplished Form (A copy shall be sent to PNP-Makati HR Personnel
Division and may also be downloaded from PLEB – Makati Facebook Page.)
 PNP ID
 Service record or duty status if the purpose is for Retirement, Promotion,
Lateral Entry, and Transfer of Assignment.

b.3. Send the e-mail to: makatipleb@yahoo.com

2. The Secretariat shall acknowledge receipt of the e-mail.

3. After the Secretariat has verified its records, the police officer shall receive an e-mail
reply containing his or her signed clearance or an e-mail reply stating the denial of the
application and the reason therefor.

4. All clearances shall be processed within three working days from receipt of the
application.

III. Procedure for Filing Complaint

1. The PLEB through its Secretariat shall receive all complaints filed by any party. The
initiatory pleadings, together with all the required documents in relation thereto, may
either be filed electronically through e-mail sent to its e-mail address
(makatipleb@yahoo.com) or through mail sent to People’s Law Enforcement Board, 8th
floor, Makati City Hall Main Building.

An administrative complaint may be initiated by filing any of the following,


accompanied by a certificate of non-forum shopping duly subscribed and sworn to by the
complainant, affidavits of witnesses, if any, and other evidence in support thereof.

a. Notarized complaint affidavit; or


b. Written sworn statement (Sinumpaang Salaysay); or
c. Signed letter-complaint with affirmation of identity through videoconference.
2. Other provisions of Napolcom Memorandum Circular No. 2016-02, as amended
pertaining to the mandatory contents of any pleadings, motions, and/or appeal, including
their reglementary period for filing, shall still apply.

3. Provisions of Napolcom Memorandum Circular No. 2016-02, as amended pertaining


service of summonses, notices and other orders of the Board shall still apply.

4. Answers and other responsive pleadings, motions, and appeal, together with all the
required documents in relation thereto, may either be filed electronically through e-mail
sent to its e-mail address (makatipleb@yahoo.com) or through mail sent to People’s Law
Enforcement Board, 8th floor, Makati City Hall Main Building.

IV. The Board – Meeting and Deliberation

1. Deliberations and Meetings

The deliberation for the initial evaluation of the complaint to determine if it has
jurisdiction and the deliberation to decide a case or any motion may be heard through
videoconferencing. Should any of the PLEB members not have any means to attend
through videoconferencing, he or she may inform the Secretariat about such fact. The
Secretariat shall set up a complete computer unit for videoconferencing at the PLEB
office and such PLEB member may attend the meeting thereat.

The PLEB members shall conduct their meeting twice a month, or as often as may
be necessary.

2. Conduct of Pre-Hearing Conference and Clarificatory Hearing

The conduct of pre-hearing conference and clarificatory hearing may be heard


through videoconferencing. However, should any of the parties or any of the PLEB
members not have any means to attend the conference or hearing, he or she may inform
the Secretariat about such fact. The Secretariat shall set up a complete computer unit for
videoconferencing at the PLEB office and the informing party may attend the conference
or hearing thereat.

In both circumstances, the health hygiene protocols and other minimum health
standards, e.g., wearing of face masks and face shields, subjecting everyone to a no-
contact thermal scanning, and observance of social distancing, shall be strictly observed.
