Subject: JUSTIFICATION FOR THE PROCUREMENT OF “16-Port Gigabit Switch – TP


Link Brand”

Dear Ma’am/Sir:

Greetings!

This letter pertains to the Pre-Audit Observation of the Accounting Office regarding the
voucher payable to Electrocomputer Data System, Tacloban City for the Supply and Delivery of
IT Equipment and Peripherals amounting to PhP554, 930.00 wherein they cited branding/brand
name reference, re: 16 Port Gigabit Switch TP-Link, as contradicting to Section 18 of RA 9184
and its Revised IRR.

Section 18 of the old IRR of RA 9184 provides for the Reference of Brand Names as to specifications
for the procurement of goods to be based on relevant characteristics and/or performance requirements and
reference to brand names shall not be allowed. However, same section in the 2016 Revised IRR of
RA 9184 2016 now states that “Specifications for the procurement of Goods shall be based on relevant
characteristics, functionality, and/or performance requirements. Reference to brand names shall not be
allowed EXCEPT for items or parts that are compatible with the existing fleet or equipment of the same
make and brand, and to maintain performance, functionality and useful life of the equipment.”

We, at the Office of the Municipal Assessor, the end-user of the said network hub/switch have
an existing TP-Link Router that needs 16-Port Gigabit Switch to connect with more computers
for networking. We tried to connect the 16-Port Gigabit Switch with different brands but to no
avail, failing the networking after several attempts. This prompted us to procure 16-Port Gigabit
Switch with a TP-Link brand to solve the compatibility and functionality issue with our TP-Link
Router.

Hence, this letter of justification to warrant our procurement of 16 Port Gigabit Switch TP-Link.
