Issue

Can spiderman recover the cost of stationery from Ironman.

Rule

 Persons under 18 years have limited capacity to enter contracts under common law
 Beneficial contracts of service must provide “an overall benefit”

Application

Ironman who is an undergraduate student of a university got into contact with Spiderman. So
basically Ironman who is said is a minor have limited capacity to enter into contacts. Limited capacity
in simple terms means that the person is unable to make fully informed decision concerning his/her
life. This contract that was between Spiderman and ironman can be said as a beneficial contract of
service. This is where the minor is eligible to be into contract for the benefit of service.

Under common law it can be said that ironman who is a minor is uneligible into entereing into
certain contracts. beneficial contract of service is one in which ironman can enter into as it is said to
be a valid contract.

Furthermore, the beneficial contract of service in which spiderman and ironman is binded into
provides an overall benefit to ironman. As in this case the benefits were that ironman got stationary
supplies from spiderman such as laptops and others. Another benefit that flow towards ironaman
was that as he did not qualify for the schlorship rather he was being helped out by spiderman in
acquiring his education successfully.

Related case: Robert v Gray (1913)

In this case gray who was a billiard player entered into the contract with Robert to tour and promote
the tour and therein Robert will incur all the cost. As gray changed his mind, Robert sued gray for
breach of contract. In the court Robert was succesfull and the court ordered gray for the damages.

Conclusion

The contract was a valid contract between ironman and spiderman and ironman did breach the
contract.thus, Spiderman will be succefull in recovering the costs of the stationary from ironman.
