1. a. No, though it is stipulated that non-payment of the consideration will result to a right to demand
the fulfillment or cancellation of the obligation, non-payment would still generally require a judicial or
extra judicial demand before default can arise, meaning if no demand was made, no delay was
committed.

2. No, according to R.A. 6552, Sec. 4, In case where less than two years of installments
were paid, the seller shall give the buyer a grace period of not less than sixty days from
the date the installment became due. If the buyer does not pay the installments due at the
end of the grace period, the seller may cancel the contract after thirty days from the buyer's
receipt of the notice of cancellation or the notarial demand for rescission of the contract.
