Advantages and disadvantages of Predetermined Punishments

Among the highly debated issues in the contemporary world relates to if predetermined

punishments should be adopted for every crime. Others think that it is important for motivation

and circumstance to be considered behind all crimes. I will shed some light on the advantages

and disadvantages of predetermined punishments. 

One of the advantages of predetermined punishments is that it would assist in lessening

the time of judging, hence saving resources and time. All lawbreakers would be sentenced to

similar punishments if they happen to commit similar crimes. For instance, a thief who stole

$100 and another thief who looted $200 would equally be sentenced to, let’s say, 5 years in jail.

Apart from that, all criminals could obtain a similar judgment under the law system. Openly,

fairness among criminals could directly be established. 

One of the disadvantages of predetermined punishments is that the motivation for

committing a certain crime and a particular crime’s conditions would go unnoticed, given that all

cases are significantly not the same from one another. For example, the case of murdering for

self-defense should not be the same as killing for fun. Self-defense needs to be regarded as a

rational motivation and therefore, the one who committed the murder does not have to receive a

similar judgment to that of a twisted-minded murderer. For this reason, other significant factors,

like the circumstances and motivation, have to be considered as well for coming up with

judgments that predetermined punishments are wrong.


In conclusion, predetermined punishments are good, but could result in additional burden

at the same time. All things considered, predetermined punishments should not be carried out as

other factors like the motivation behind committing the crime needs to be considered.
