, (i) Rule 40(8) - " V[hoever removes minor mineral without valid lease / permit
or on whose behafsuch iemoval is made otherwise than in accordance with
these Rules he be an agen\ Manager, Contractor or a sub-lessee, shall be
presumed to be a party to the illegal removal of the minor mineral and shall
be liable to pcy (the price thereof and the Governtnent may also recover
from such person rent, royalty or taces as the case m6y be, for the period
during which the land was occupied by such person witlnut any lav'fu|
outhorig) without prejudice to other action being taken against him under
tlese Rules or ilry otlrer lan, for the time -being in Force.
(ir) Rule 40(9)- Notwitlutanding anything contained in rule 40(8) hereinbefore
wltosoever, under the terms of an agreement other than an agreetttent under
these rules at any time has received or receives cost of mirnr mineral/
rnaterial including royalty under the terms of the said agreement shall
deposit -that royalty whlch is irrcluded in srch cost of mineral / material in
the manner prescribed in rule 43 Inreinqfter, within seven days from the
date of receipt of such cost of mineral / material.
Any royalty received cJ' sach by such person befare tlv
carntilencement of this rzh sh4ll be deposited by him within lifieen days
from the date of commencement oJ this rule.
Provided that d a sum eqial to tle royalty ineluded in tlrc cost of
mineral / material so received has already been paid or deposited prior to
receipt of cost of the mineral / material including royalty by him lw slnll
rut be required to deposit the royalty said obove.
Providedfurtlwr that any royalty payable under this rule, if not paid
when due be rccoveredwith interest @ 15 percent per armum as cm arrear
sum ofpublic demand."
(iiD Rule 40(10)- nTo prevent evasion of royalty it is provided tlut works
contractor shall purchase the miwrals from lessee/perwit holder and
n$horized dealers ody and no Worfu Department shall rcceive the bill
which the wolks contractors suhmit to recaver cost etc. of mineral used by
tlpm in completion of tlte worfu of tlu Works Departrnent under ary
agreementfrom tle worb contractor if the said bill is not rc.campanied by
an ffidavit in Form "M" with particttlars in Fonn "N" af tlrcse rules along
with a photo copy of the said afidovlt and particulars. It shall be tlw duty of
the oficer wln recehtes or onwhose belnlf the said bill is reeived to xnd
the platocory of the Afidnvit and particulms to the District Mining
Olficer/Assistant Mining Oftcer within whose jurisdiction tla mfueral was
al I e ge dly p urchm e d, for v e r tfi c at ion.

District Mining Offrcer/Assistant Mtnfug fficer is found to be false either
wholly or partly is shall be presumed that the concerned mirrerals was
obtained by illegal mining and in that event the said District Mining
