ORDINANCE POWER

 Executive orders (Kautusang tagapagpaganap), 


-according to Book III, Title I, Chapter II, Section
2 of Administrative Code of 1987, refer to the "Acts of the
President providing for rules of a general or permanent
character in implementation or execution of constitutional or
statutory powers." 
Ex.
Executive Order No. 292, which instituted the Administrative Code
of 1987, is an example of an executive order.
-Its primary function is to prescribe the standards, guidelines and
practices within the executive branch of government.
-It is the Administrative Code which establishes the various Cabinet
departments and offices falling within the executive branch of government,
and under the direct control and supervision of the President.

Executive order No. 209, FAMILY CODE


- The basic law covering persons and family relations governs
marriages, legal separations, property relations between spouses,
and parental authority, among others.
 Administrative orders(Kautusangpampangasiwaan) 
-According to Book III, Title I, Chapter II, Section
3 of Administrative Code of 1987, refer to the "Acts of the
President which relate to particular aspects of
governmental operations in pursuance of his duties as
administrative head."

Legislative Act is the creation & promulgation of a


general rule of conduct without reference to particular
conduct.
Administrative act is the application of a general rule
to a particular case.

Completeness test – the law must be complete in all its


terms and conditions when it leaves the legislature such
that when it reaches the delegate the only thing he will
have to do is enforce it.

Sufficient standard test – there must be adequate guidelines


or stations in the law to map out the boundaries of the
delegate’s authority and prevent the delegation from running
riot.
