Good day Atty. Neng, invited panelist and clasmates, How are you? I hope everyone is
safe and healthy.
By the way, I am Edrich John Labrador, one of th students under the class of Atty.

We are task to present topic on PURCHASE THE REAL PROPERTY OF PROBLEM -
AGRICULTURAL LAND. LABRADOR
My classmates will present a brief screenplay regarding the FACTS given to us.

LABRADOR In the given situation, what are the stages of sale and needed documents to prepare in a
contract of sale.
The subject land here has a Title Number of 146-2017012345 located at Catalunan
Grande, Davao City. Only 36,442 sqm was sold with a price value of Php2,000/sqm to
buyer. The said land was classified as agricultural. There is also an aerial footage
available as you can see in the slide.
The seller here is dying and is confined in a hospital in Metro Manila. The seller is also
single and no issue. The seller has four siblings and whose mother is still alive. The
seller wants her trusted friend to represent her during the sale. The seller doesn’t want
to pay any taxes and the reason for selling is that the seller is in dire need of money.
The buyer here is a family corporation represented by the mother and is willing to pay
Php2,000/sqm. The company is also willing to give earnest money before the final
approved survey plan submitted. The company also want to be assured that the property
has no liens and encumbrances and no pending litigation of any kind. They also want to
be assured that the property is not subject to any claims by third parties and willing to
pay taxes except the RPT. They want the property also knowing that part of the same
property was already bought by Camella.
Now, the question here is What documents to prepare taking into consideration all the
conditions and situations of both parties?

REMULTA Slide # 8: The seller is dying and currently in Manila. However since she is in dire need
of money, she wants to push through with the sale of her property.
Slide #9: She executed a Special Power of Attorney authorizing her trusted friend to
negotiate, sell, convey and sign on her behalf with any prospective buyer of her
property located at Catalunan Grande Davao City.
Slide #10: After receipt of the letter of intent given by the buyer, XYZ corporation, the
seller sent a reply to the buyer signifying her acceptance on the intent to purchase her
property, stipulating that the price shall be exclusive of taxes and that the buyer must
shoulder all taxes on the said transaction. She also told the proposed buyer that the
earnest money must be given as soon as possible and that the TCT will only be released
upon receipt of the full purchase price.

ORCAJADA Slide #11: This is the letter of intent to purchase the real property by the corporation. It
shows the terms and conditions for which the buyer is willing to buy the property.

This is the secretary’s certificate. A secretary’s certificate or board resolution is the


source of authority for a person to act in behalf of the corporation. It shows that Juana
dela cruz, the mother, is authorized to negotiate and purchase the subject property

These are the terms and conditions agreed upon by the Corporation and Ivana Alawi.

This is the letter of intent to purchase the real property by the corporation. It shows the
terms and conditions for which the buyer is willing to buy the property.

b. GET A UPDATED CERTIFIED THRU COPY OF TCT (ROD) - CAGRO


c. CHECK THE LAND HOLDING (CITY ASSESSOR) - CAGRO

d. CHECK THE STATEMENT OF ACCOUNT IF THERE IS PENDING REAL PROPERTY TAX (CITY
TREASURER) IF NONE. GET A CERTIFICATE THRU COPY TAX CLEARANCE – CABRERA

e. CHECK THE ZONING OR LAND USE PLAN OF THE SUBJECT PROPERTY IF FIT THE USE OR PURPOSE
OF BUYING. – MAMBURAM
f. CHECK IN THE CITY EGINEER OFFICE IF THE PROPERTY HAS A BUILDING OR PLANT -
MAMBURAM
i. IF THE BUILDING PERMITS IS CONFORM- CHECK THE TAX DEC IF ALL OF THE
IMPROVEMENT IS DECLARED. Eg. Waste disposal
ii. IF NONE INFORM THE SELLING BROKER FOR THE NEGOTIATION OF THE PRICE.
Eq. the buyer will deduct the cost of application the building permits and compromised agreement penalty.

3. CHECK THE TIN OF THE SELLER BOTH HUSBAND AND WIFE (BIR) IF THERE IS TAX DELIQUENCIES –
CABRERA

4. GO TO LRA GET A TECHNICAL DISCRIPTION AND CADASTRAL MAP (FOR PRIVATE SURVEY) THIS WILL BE
USE THE RELOCATION SURVEY AND PARTITION OF THE PROPERTY. TO CHECK THE BOUNDARIES AND
