SUBSTANCE OF ACCUSED

It is alleged by the complainant that you being known

person, had borrowed a lease agreement amount of Rs.
Rs.7,50,000/- issuing two cheques bearing No.211007 &
211008 which was accepted by accused and the cheques
were duly honored and en-cashed into accused’s account
after presenting the same to his banker on 25.07.2017 and
26.07.2017 and towards discharge of the said debt, you have
issued a two cheques bearing No.439101 dtd. 13.03.2019 for
a sum of Rs.4,00,000/- and another cheque bearing
No.439102 dtd. 13.03.2019 for a sum of Rs.3,50,000/-
drawn on SYNDICATE BANK MALLESHWARAM.,
BRANCH, BANGALORE, in favour of the complainant and
the said cheque on its presentation bounced back unpaid
with an endorsements as “FUNDS INSUFFICIENT” and
you did not make payment of the said cheques amount
within the time stipulated after issuance of statutory notice
and thereby you have committed an offence punishable U/s
138 of N.I. Act.
