The hearing has been conducted through Physical Mode.
1. The petitioner who is a minor had filed this petition through Gaurav,
her next friend, praying for her safety, security and a safe shelter, to ensure
her admission in Class 12 and to take cognizance of the complaint of the
petitioner against respondent No.4 and 5 who are her parents.
2. In the present petition the petitioner who is a minor states that she left
her parental home on 17th June, 2021 as her parents and other family
members were treating her in inhumane and barbaric manner and were
trying to ruin her life.
3. When this petition came up before this Court, this Court interacted
with the petitioner who stated that she left her parental home on 17th June,
2021 since her parents were beating her, letting her not go out of house, not
permitting her to go to study and intending to marry her with an old man.
Thus, on that date while issuing notice to the parents of the petitioner, this

Court directed the petitioner to be lodged at Children’s Home, Nirmal
Chhaya.
4. Today the petitioner has been produced by the investigating officer.
Respondent No.4 and 5, her parents are also present. She states that in fact
on 17th June, 2021 she left her parental home and started living with Gaurav
and now she wants to live with her parents. Respondent No.4 and 5, the
parents of the petitioner are also present. They stated that on 17th June,
2021 the petitioner went missing so on 21st June, 2021 they lodged a
complaint on which a FIR was registered under Section 363 IPC. The
parents of the petitioner suspected that Gaurav had kidnapped their daughter
and when investigation was intensified, Gaurav produced the petitioner
before this Court.
5. Today Gaurav is also present. The prosecutrix states that there was
no fault of Gaurav and she left her parental home of her own choice.
6. Be that as it may, since the petitioner is a minor and wants to go to her
parent’s home she is permitted to go in the custody of her parents.
However, this petition is kept pending to ascertain the welfare of the
petitioner. List this petition on 28th September, 2021 when the petitioner, her
parents and Gaurav will be present in Court.
7. Order be uploaded on the website of this Court.
