The importance of rights of a person in the custodial investigation in traffic and accident
investigation is to know what happened because we can use them to narrate the happening
of the crime. The person has rights in the custodial investigation in traffic and accident
because we can interview them and the objective of the law enforcement is to get more
information about the crime that happened. The custodial investigation shall include the
practice of issuing an "invitation" to a person who is investigated in connection with an
offense he is suspected to have committed, without prejudice to the liability of the "inviting"
officer for any violation of the law. Sec. 3. Assisting Counsel. It is the policy of the Senate to
value the dignity of every human being and guarantee full respect for human rights. Sec. 2.
Rights of Persons Arrested, Detained, or under Custodial Investigation; Duties of Public
Officers. - (a) Any person arrested detained or under custodial investigation shall at all times
be assisted by counsel. For example, In Antipolo city have an incident between a car and a
truck. A truck lost the break and the truck stroke the car and then this incident was the cause
of long traffic. The law enforcement can’t see the incident so that here is needed the person
who saw the incident. Law enforcement can interview the person who near of person near
about stroke between a car and truck.
