SUBSTANTIVE AND PROCEDURAL LAW IN MALAYSIA

1. Substantive Law is a Statutory Law that deals with the relationship


between the people and the State. Substantive Law defines the rights and
the duties of the people.
2. Procedural law is a law that establishes the rules of the court and the
methods used to ensure the rights of individuals in the court system. In
particular laws that provide how the bussiness of the court is to be
conducted.

SUBSTANTIVE LAW IN MALAYSIA:

1. Is the statutory or written law that governs the rights and obligations of
those who are subjected to it.
2. It defines the legal relationship ( right and obligations) of people with
other people or between them and the state
3. It refers to all categories of public and private law
4. Some of substantive law was derived from prnciples found in judicial
decisions or in common law.

PROCRDURAL LAW:

1. It compromises the rule by which a court hears and determines what


happens in civil lawsuit or criminal proceedings
2. The rules are designed to ensure a fair and consistent application to all
cases

For example : Time allowed for one party to sue another.
