Subject: Unnatural death of the child and request for the compensation.

Sir,

The National Commission for Protection of Child Rights (NCPCR) has

been constituted under the provisions of the Commissions for Protection of
Child Rights (CPCR) Act, 2005 for protection of child rights and other related
matters. One of the functions assigned to the Commission under Section 13 (1)
(j) of CPCR Act, 2005 is to inquire into complaints and take suo-motu
cognizance in relation to deprivation and violation of child rights.
 
2.        The Commission received the complaint on the above subject matter
(copy enclosed) on 14.11.19. It has been alleged as under:
 
“Adarsh Kumar Das s/o Manas Kumar Das and Arti Das was a student of DAV
Public School, Garapur, Kendrapara, Odisha resident of Taripatna, PO- Alava
Block- Aul, Kendrapara, Odisha had gone with his cousin to the river for
getting fresh and he accidentally fell into the river on 24.03.18 and died. They
had only son and they are very poor so they need compensation.”
 
3.        After perusing the complaint, it has been decided to take cognizance of
the matter and the matter has been referred to you for investigation/inquiry
and further necessary action. A detailed factual report, along with
authenticated copies of the relevant documents to the Commission within 15
days of issue of this letter. The Report should indicate inter-alia the information
on the following:

(i) Details of action that has been initiated against the accused;
(ii) Death certificate.
(iii) Letter of acknowledgement from the school.
(iv) Letter of recommendation from Panchayat Samiti Member, Aul.
 (v) Authenticated copies of all the relevant information in the
matter is mandate.
