The legal framework for the protection and promotion of women’s human rights Equality between men and women has been among the most fundamental guarantees of human rights. The Universal Declaration of Human Rights was adopted in 1948 proclaiming equal entitlements of women and men to the rights contained therein without any distinction of any kind, such as sex! when it explicitly declared that all human beings are born free and equal in dignity and rights? Then came the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. The Convention defines “discrimination” as any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment, exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.® Discrimination, in the context of the said covenant, encompasses any difference treatment on the ground of sex which intentionally or unintentionally disadvantages women, prevents society as a whole to recognize women’s rights in both the private and the public spheres and prevent women from exercising the human rights and fundamental freedoms to which they are entitled” ‘These principles of international human rights instruments, to which the Philippines is a signatory, forms part of the law of the land by virtue of Section 2, Article 1 of the 1987 Philippine Constitution. It is thus declared that the State values the dignity of every human person and guarantees full respect for human rights* and ensures the fundamental equality before the law of women and men. In this light, Republic Act No. 9710, otherwise known as the Magna Carta for Women (MCW) was enacted explicitly declaring to protect women’s human rights from violations by private corporations, entities and individuals, promote and fulfill women’s rights in all spheres. Sexual harassment: a gender-based violence One of the many forms of violence against women that seriously inhibits women’s ability to enjoy rights and freedoms on a basis of equality with men is sexual harassment." Sexual harassment in the Philippines was first given its definition in 1995 after the enactment of Republic Act No. 7877 or the Anti-Sexual Harassment Act of 1995 by Congress, viz: "SECTION 3. It does not specifically address the issue of “hostile environment” resulting from sexual harassment between peers or co-employees.!? This means, situations where the offender and offended party are peers or have the same rank or status, or when the offended party is the superior officer in a work or education environment, the same cannot be considered as sexual harassment since these are not within the scope of Republic Act No. 7877. Moreover, Republic Act No. 7877 only applies in work, educational and training environments. Hence, sexual harassments that occur in, say, public ‘transportation, malls and restaurants, are excluded and, despite their ubiquity, cannot be prosecuted successfully. Bridging the gaps: Republic Act No. 11313 or the “Safe Spaces Act” Recognizing the limited scope of R.A. No. 7877 as well as the existing gaps and issues on security and safety of both women and men in private and public spaces, the Congress finally enacted Republic Act No. 11313, an Act Defining Gender-Based Sexual Harassment in Streets, Public Spaces, Online, Workplaces, and Educational or Training Institutions, Providing Protective Measures and Prescribing Penalties Therefor, on 17 April 2019. Republic Act No.11313 expands the scope of sexual harassment, places safeguards against it and provides penalty therefor. The Implementing Rules and Regulations of Republic Act No. 11313 was promulgated on 28 October 2019. Republic Act No, 11313 (and its Implementing Rules and Regulations) provides the different forms of sexual harassment such as Gender-Based Streets and Public Spaces Sexual Harassment, Qualified Gender-Based Streets and Public Spaces Sexual Harassment, Gender-Based Online Sexual Harassment and Gender-Based Sexual Harassment in Educational and Training Institutions. Under Section 4, Article I of Republic Act No. 11313 and Section 5, Rule Il of the Implementing Rules and Regulations of Republic Act No. 11313, the crimes of gender-based streets and public spaces sexual harassment are defined on how it is committed, viz: “Article [xxx Section 4. Gender-Based Streets and Public Spaces Sexual Harassment, -The crimes of gender-based streets and public spaces sexual harassment are committed through any unwanted and uninvited sexual actions or remarks against any person regardless of the motive for committing such action or remarks. Acts constitutive of ‘gender-based streets and public spaces sexual harassment are those performed in buildings, schools, churches, restaurants, malls, public washrooms, bars, internet shops, public markets, transportation terminals or public utility vehicles, xxx ooo Rule I xxx SEC. 5. Gender-Based Streets and Public Spaces Sexual Harassment. — The crimes of gender-based streets and public spaces sexual harassment are committed through any unwanted and uninvited sexual actions or remarks against any person regardless of the motive for committing such action or remarks, Gender-based streets and public spaces sexual harassment include, among others: a) Catcalling, wolfwhistling, unwanted invitations, misogynistic, transphobic, homophobic, and sexist slurs; bh) Persistent uninvited comments or gestures on a person's appearance; ) Relentless requests for personal details; 4d) Statement of sexual comments and suggestions; ©) Public masturbation or flashing of prioate parts, groping, making offensive body gestures at someone, and other similar lewd sexual actions; Any advances, whether verbal or physical, that is untoanted and has threatened one's sense of personal space and physical safety. This may include cursing, lering and intrusive gazing, and taunting; / Persistent telling of sexual jokes, use of sexual names; and g) Stalking.” Simply put, Gender-Based Streets and Public Spaces sexual harassment are those acts or remarks defined above committed by any person in public spaces and online against anyone, men, women, and other persons irrespective of whether or not it involves a condition. Inaddition, Section 11, Article I of Republic Act No. 11313 lays down the penalties for specific acts of gender-based sexual harassment in streets and public spaces, as follows: “Section 11. Specific Acts and Penalties for Gender-Based Sexual Harassment in Streets and Public Spaces, -The following acts are unlawful and shall be penalized as follows: <—m.| Gh, CHR: Dignity of all ae | _ sain ann tn cep cur Samp A San Pablo City, Laguna 4000 UKAS Contact numbers: (049) S418 9158020890 09396384705 Jem wth E-mail chié sanpablo@yahoo com (a) For acts such as cursing, wolf-whistling, catcalling, leering and intrusive gazing, taunting, pursing, unwanted invitations, misogynistic, transphobic, homophobic, and sexist slurs, persistent unwanted comments on one's ‘appearance, relentless requesis for one’s personal details such as name, contact and social media details or destination, the use of words, gestures or actions that ridicule on the basis of sex, gender or sexual orientation, identity and/or expression including sexist, homophobic, and transphobic statements and slurs, the persistent telling of sexual jokes, use of sexual names, comments and demands, and any statement that has made an imoasion on a person's personal space or threatens the person's sense of personal safety — (1) The first offense shall be punished by @ fine of One thousand pesos (P1,000.00) and community service of twelve (12) hours inclusive of attendance toa Gender Sensitivity Seminar to be conducted by the PNP in coordination with the LGU and the PCW; (2) The second offense shall be punished by arresto menor (6 to 10 days) or a fine of Three thousand pesos (P3,000.00); (3) The third offense shall be punished by arresto menor (11 to 30 days) and a fine of Ten thousand pesos (P10,000.00). (b) For acts such as making offensive body gestures at someone, and exposing private parts for the sexual gratification of the perpetrator with the effect of demeaning, harassing, threatening or intimidating the offended party including flashing of private parts, public masturbation, groping, and similar lewd sexual ‘actions ~ (1) The first offense shall he punished by a fine of Ten thousand pesos (P10,000.00) and community service of twelve (12) hours inclusive of attendance to a Gender Sensitivity Seminar, fo be conducted by the PNP in coordination with the LGU and the PCW; (2) The second offense shall be punished by arresto menor (11 to 30 days) or a {ine of Fifteen thousand pesos (P15,000.00); (3) The third offense shall be punished by arresto mayor (1 month and 1 day to 6 months) anda fine of Twenty thousand pesos (P20,000.00). (0) For acts suck as stalking, and any of the acts mentioned in Section 11 paragraphs (a) and (2), wohen accompanied by touching, pinching or brushing against the body of the offended person; or any touching, pinching, or brushing against the genitalia, face, arms, anus, groin, breasts, inner thighs, face, buttocks or any part of the victim’s body even when not accompanied by acts mentioned in Section 11 paragraphs (2) and (b) - (1) The first offense shall be punished by arresto menor (11 to 30 days) or a line of Thirty thousand pesos (P30,000.00), provided that it includes attendance in 4 Gender Sensitivity Seminar, to be conducted by the PNP in coordination with the LGU and the PCW; (2) The second offense shall be punished by arresto mayor (1 month and 1 day to 6 months) or a fine of Fifty thousand pesos (P50,000.00); CHR: Dignity of all ‘Address: 2F Mary Grace Builing Colago Avenue cor. Quezon St, B ‘San Pablo City, Laguna 4000 ‘Contact numbers: (040)552-5415/ 09156820530) 06396384786 E-mall:chrésanpablo@yahoo.com (3) The third offense shall be punished by arresto mayor in its maximum period or a fine of One hundred thousand pesos (P100,000.00). xxx" While Republic Act No. 11313 defines gender-based sexual harassment in streets, public spaces, online, workplaces, and educational or training and provides its corresponding penalty/ies, it does not end there. The law also sets forth certain obligations of business establishments such as restaurants and cafes, bars and clubs, resorts and water parks, hotels and casinos, cinemas, malls, buildings and other privately-owned places open to the public where the gender-based sexual harassment occur. Furthermore, Section 6 thereof discusses the additional penalty for gender-based sexual harassment in public utility vehicles, such as franchise suspension or revocation, or a civil action for breach of contract of carriage. Ending the culture of gender-based violence: Role of Local Government Units Section 8, Article I of Republic Act No. 11313, imposes upon the Local Government Units (LGUs) the primary responsibility of enforcing the provisions under gender-based streets and public spaces sexual harassment (Article 1). This includes passing an ordinance to localize the applicability of the said law within sixty (60) days of its effectivity on 03 August 2019" and to disseminate or post in conspicuous places a copy of the law and the corresponding ordinance. The duty of the LGUs to pass the said ordinance is expounded in Section 3, Rule 5 of the Implementing Rules and Regulations of Republic Act No. 11313 in this wise: 28 Section 5. Gender-Based Sexual Harassment in Restaurants and Cafes, Bars and Clubs, Resorts and Water Parks, Hotels and Casinos, Cinemas, Malls, Buildings and Other Privately-Owned Places Open to the Public. -Restaurants, bars, cinemas, malls, buildings and other privately-owned places open to the public shall adopt. zero-tolerance policy against gender-based streets and public spaces sexual harassment. These establishments are obliged to provide assistance to victims of gender-based sexual harassment by coordinating with local police authorities immediately after gender-based sexual harassment is reported, making CCTV footage available when ordered by the court, and providing a safe gender-sensitive ‘environment to encourage victims to report gender-based sexual harassment at the first instance. ‘All restaurants, bars, cinemas and other places of recreation shall install in their business establishments clearly-visible warning signs against gender-based public spaces sexual harassment, including the anti- sextal harassment hotline number in bold letters, and shall designate at least one (1) anti-sexual harassment officer to receive gender-based sexual harassment complaints. Security guards in these places may be deputized to apprehend perpetrators caught in flagrante delicto and are required to immediately coordinate with local authorities ¥ Section 6. Gender-Based Sexual Harassment in Public Utility Vehicles, In addition to the penalties in this ‘Act, the Land Transportation Office (LTO) may cancel the license of perpetrators found to have committed acts constituting sexual harassment in public utility vehicles, and the Land Transportation Franchising and Regulatory Board (LTFRB) may suspend or revoke the franchise of transportation operators who commit gender-based streets and public spaces sexual harassment acts. LGUs shall have the following duties: 1. Passan ordinance that shall localize the applicability ofthe law within sixty (60) days from its effectivity. Suck an ordinance shall consider and address the particular circumstances prevalent in their respective jurisdictions. Ordinances passed pursuant to this law shall, to the extent possible: contain measures that will prevent the occurrence of GBSH such as provision of gender sensitivity training (GST), orientation on the law, creation of ofices and appointment of people that will be responsible to address GBSH, including instances falling within the Katarungang Pambarangay system; create measures to efficiently respond to the issue such as clear protocols of reporting and responding to GBSH, and programs to help the victims as well as perpetrators; and ensure that there are mechanisms, people and budget to effectively respond to GBSH. Provided, however, that the passage of an ordinance shall not serve as a prerequisite for the implementation of the law by LGUs. The pendency of proceedings to adopt such local ordinance shall not be construed as a bar for LGUs from implementing the law; b) Disseminate or post in conspicuous places a copy of the law and the corresponding ordinance. The LGUs may come up with information, education, and communication (IEC) materials on the law and/or ordinance which may be in their respective local languages; xxx.” ‘The mandate of Republic Act No. 11313 for the LGUs to pass an ordinance to localize gender-based streets and public spaces sexual harassment cannot be overemphasized. By providing period within which to issue the same, it only means that there is a pressing need for the enactment of this ordinance for its full and proper implementation. DILG-PCW Joint Memorandum Circular No. 2020-001 dated 07 December 2020: “Guidelines on the Localization of the Safe Spaces Act” To guide the LGUs in the enactment of such ordinance, the Department of the Interior and Local Government (DILG) and the Philippine Commission on Women (PCW) joined hands and inked the Joint Memorandum Circular No. 2020-001 entitled "Guidelines on the Localization of the Safe Spaces Act" on 07 December 2020. Paragraph 5.1 of the said Circular provides for the specific duty of LGUs" to localize gender-based streets and public spaces sexual harassment (Article I of Republic ‘Act No, 11313) thru an ordinance, in line with the provision of Section 8, Article lof Republic ‘Act No. 11313, to prevent the occurrence of and efficiently and effectively respond to gender-based sexual harassment in streets and public spaces and to designate public spaces, regardless of ownership and nature as safe spaces against gender-based sexual harassment.” Undoubtedly, the duty of the LGUs to enact an ordinance localizing Article 46 Provinces, Cities, Municipalities and Barangays. 5.1.14, 5.12.1 and 5.1.3.1 of Joint Memorandum Circular No. 2020-001 CHR: Dignity of all ‘Adérece: 2 Mary Grace Building Colago Avenue cor. Quezon St, Barangay ‘San Pablo City, Laguna 4000 Contact numbers: (048)562-5418/ 09156020530" 09306384786 ‘E-mail ohré-sanpablo@yahoo com I of Republic Act No. 11313 is vital for the efficacious implementation of Republic Act No. 11313 or the Safe Spaces Act. ‘Thus, this Office calls on the Local Government Units across Region IV-A to perform its duties under Section 8, Article I of Republic Act No. 11313 and its implementing Rules and Regulations, and Joint Memorandum Circular No, 2020-001, as follows: 1. Pass an ordinance localizing Republic Act No. 11313 or the Safe Spaces Act which shall contain (but not limited) to the following details'* at the soonest possible time: a. Provision on gender sensitivity training (GST) and orientation on the law to the concerned government agencies or individuals; b. Creation of offices and appointment of people responsible to address gender-based sexual harassment, including instances falling within the Katarungang Pambarangay system; ¢. Formulate clear protocols of reporting and responding gender-based sexual harassment which includes mechanisms, people and budget to effectively respond to GBSH; and d. Implement welfare programs to help the victims as well as perpetrators of gender-based sexual harassment; and ensure that there are mechanisms, people and budget to effectively respond to GBSH. 2. Disseminate or post a copy of the law and the corresponding ordinance in conspicuous places. Final note from the Commission on Human Rights In closing, the Commission emphasizes that the passage of Republic Act No. 11313 paved the way for the protection of any person from gender-based streets and public spaces sexual harassment, which have largely remained neglected for many years.
