In this case the honorable supreme court take suo moto and decide to settle law.

As we can see
in trail courts decision that evidence not proper and the trail court observe this in para 6 of the
proposition that the non of the witness examined by the prosecution were present on the crime
scene or are even reliable . This show there huge injustice and also it is our settle principle that
hundred accused may be proved innocent but one innocent can not be punished but here trail
court s decision is not proper. main aim of the Criminal Justice-System is to ensure fair and
impartial trial of each and every accused who has been put behind bars in this case we did not
challenges the validity of evidences at first instance…………reason…………………. But at
later in appeal we raised the question on reliability of the evidence but court refuses to accept on
the ground that this matter should be raised in trail court at first instance but as interpretor of
constitution and protector of right the honorable court should settel the law in such a way that if
the question about evidence in first instance is not raised the party is free to raise it at latter stage
which is appeal . This will help in achieving the aim criminal justice delivery system.
