Introduction

Considerations EU Directive 2019/883:

“To ensure the adequacy of port reception facilities, the


development, implementation and re-assessment of the
waste reception and handling plan is essential, based on
the consultation of all relevant parties. For practical and
organisational reasons, neighbouring ports in the same
geographical region might want to develop a joint plan,
covering the availability of port reception facilities in
each of the ports covered by that plan while providing a
common administrative framework.”

Article 5 Directive Waste Reception and
Handling Plans

- Member States shall ensure that an appropriate


waste reception and handling plan is in place
- Member States shall ensure that information from
the waste reception and handling plan on the
availability of PRFs in their ports and the
structure of the costs is clearly communicated.
- Where required for reasons of efficiency, the
waste reception and handling plans may be
developed jointly by two or more neighbouring
ports in the same geographical region.

• Member States shall evaluate and approve the


waste reception and handling plan and ensure its
re-approval at least every five years.
• Small non-commercial ports which are
characterized by rare or low
traffic from recreational craft
only may be exempted.

Development of a PWMP

PWMP plan is a living document, preferaby


public and legally binding and established in
consultation with all relevant stakeholders like
the harbormaster, shipping agents, waste
operators, refineries, various terminals,
municipalities, environmental authorities and other
government agencies

waste management
• List of existing PRFs
• Assessment of the need for additional PRFs
• Overview of type and quantitites of ship-
generated wastes/residues received and handled

• Not applicable to naval ships, naval auxiliary
ships and other ships in service of a State

SECTION 3: AREA OF APPLICATION –


exemptions
• For ships which frequently and regularly call in at
certain ports the obligations regarding
notification, delivery and payment can be
disproportionately burdensome: exemption can
be granted
• Inspectorate determines whether the ship is
eligible for exemption.
• Exemptions are valid for a maximum of 5 years
• Reduction using MDO/MGO/LNG

• Fee obligation applies to all seegoing vessels


• The Port of Rotterdam Authority collects the
indirect fee at the same time as the seaport dues
for all port managers of the Rotterdam-Rijnmond
Port Region
• Basis of the indirect fee system: the fee consists
of a fixed fee and a fee per Gross Tonnage
(maximised at 30.000GT). Disposal
reimbursements consists of a fixed and a variable
amount of euros per m3.

Ships outside the financing system:
• vessels for which an exemption has been granted
• vessels equipped or used commercially for sports or leisure
purposes and which may not carry more than 12
passengers.
• fishing vessels
• dredgers
• sounding vessels
• port tugboats
• a seagoing vessel which visits the port in transit to/from
the hinterland or exclusively for bunkering, provided that
the ship does not stay in the Port for longer than four hours
• seagoing vessels which use gas oil or LNG (MDO/MGO/LNG)
as propulsion fuel, only insofar as these vessels deliver oily
ship waste

SECTION 5: PORT RECEPTION FACILITIES

• Capacity requirements: number of seagoing


vessels/visits and number of deliveries of waste
• Port reception facililities: 16 owners have been
designated in the Rotterdam-Rijnmond Port
Region as PRF. A designation from the Municipal
Executive pursuant to the provisions of the local
port (management) bye-laws is needed for
owners.
• Monthly reporting.

Yearly report to Minister of Transport and Water
Management, including a summary of:
• total of the costs in connection with the collection,
storage and processing of ship waste;
• total quantity of ship waste collected, stored and
processed;
• total quantity of ship waste and other harmful
substances and residues of harmful substances
collected and stored;
• types of waste according to Annex and category;
• quantities of waste collected (indirect);
• quantities of waste collected (direct);
• percentages of collected waste.
