respondents/ State.
While the learned counsel for the petitioners have prays for urgency
and requested for early disposal of the writ petition, Shri J. K. Jain, learned
Assistant Solicitor General and Shri Vikram Singh, learned Standing counsel
have submitted that Ministry of Mines have decided to file transfer petition
under Article 139A of the Constitution of India before the Hon'ble Supreme
Court requesting for transfer of all the identical cases pending before the
different High Courts for analogous hearing and disposal and the learned
counsel for the respondents have requested at least 8 weeks time for that
purpose.
Learned counsel appearing for the petitioner submits that mere fact that
the Ministry of Mines has taken a decision to move an application for transfer
of these matters and other matters pending before the High Courts to the
Supreme Court, in the Supreme Court it should not be the reason for
deferring hearing of these matters. In any case, the prayer for grant of 8
weeks for this purpose is not justified.
Since the learned counsel for the petitioners have opposed the prayer
for grant of such a long period of time, we are inclined to grant time of four
weeks to the respondents to apprise this Court about the filing of transfer
petitions.
Matter to come up on 26.10.2021 along with W.P. No.10718/2021,
2 WP-9956-2021
W.P. No.10951/2021 and other connected matters.
In the meantime, the State Government and Union Government shall
file reply in all those cases where they have not filed the reply.
