CHAPTER 9: SCOPE FOR FURTHER STUDIES.

In the present age of technology advancements, industrialization coming

to multinational pharmaceutical companies need have been felt to know
about the ever increasing problem of passing - off and infringement of
pharmaceutical products. To meet with the new challenges, of diverse
problem of Trade Mark Law, there is an urgent need to innovate the new
technique and parameter to understand the problem of infringement and
passing off. The study of National and International level have shown that
till date, though the contribution have been made by trading people,
advocates and judges, in the development of the Trade Mark Law to meet
the global and domestic challenges. In view of Trade Mark amendment
Act, 2010, this has inserted special provisions relating to protection to
Trade Mark to international Registration under the Madrid Protocol
which has recently come into force in July, 2013. Looking at the Indian
situation the subject of further research to investigate how for the
practical problem of Infringement and passing off which has global
effect, will have to be studied by the future researcher.
