| have had an opportunity to fully review the police file in the above homicide,
including police reports, written statements and the various camera angles from the
business that captured this event. All evidence establishes that the deceased, Mark
Russell, incited this situation at the Poptronics Electronics store. He displayed angry,
threating, and abrasive behavior. In addition, it was readily noticeable to those present
that Mr. Russell had been drinking. This all created a hostile situation that business
owner Andrew Reamer attempted to diffuse by explaining his company would un-install
the radio Mr, Russell had just purchased and refund his money.
The video depicts Mr. Russell yelling at employees creating a hostile
environment, as seen and explained by both employees and customers alike. Once
back outside, a surveillance camera located within the garage that records both audio
and video captured the entire incident. Although the situation escalated rapidly, a
thorough review records Mr. Russell's explosive temper erupting both verbally and
physically as he smashes a wood pole on his truck that created a makeshift weapon.
Further, one can hear Mr. Russell shouting “"! spent $500 . . . He’s gonna
threaten me? . . . he thinks I'm a bitch . .. you gonna threaten me? . . . you better call
the 5-0, or bring a gun . .. cause | ain't fuckin’ playin’ ... Let's Rock! . .. Come on shoot
me, shoot me!”
Itis at that point Mr. Russell (with homemade weapon in hand) charges at Mr.
Reamer, who, until then is not observed on camera. This all occurs in a matter of
seconds. At this point Mr. Reamer is armed with a handgun he owns lawfully and has a
license to carry. As Mr. Russell charges at Mr. Reamer, Reamer is observed swinging,
rather than aiming, his handgun at Mr. Russell, in what appears to be an attempt to
aeeitmrDatinrncuntrod aa (nel)strike Mr. Russell with the gun. Clearly, however, Mr. Reamer discharges the gun once,
striking Mr. Russell.
At that point, Mr. Reamer acts in a manner that can be described as reasonable
under the circumstances. He appears to be near hysterical, calls 911, remains at the
scene, and keeps his handgun ready and available for responding officers/detectives to
inspect and recover as evidence. He also voluntarily responded to headquarters to be
interviewed.
As you know, it is my Office's responsibilty to prove a case beyond a reasonable
doubt. Itis my Office's determination that there is a complete lack of evidence to
establish that Andrew Reamer was acting with criminal intent during the above
homicide. In fact, his behavior and actions are more in line with a defense of self-
defense, as described above.
Accordingly, my office is declining to prosecute Mr. Reamer on any charges
stemming from the incident occurring in the above CC number.
