Facts: in the hype of oakwood mutinee, Then President Arroyo declared a proclamation
no.427 " State of Rebellion" and General Order no. 4. " calling out the arm forces to
suppress rebellion". Days after the oakwood occupation has ended lift the state of
rebellion through Proclamation No. 435 "Declaring that the state of rebellion has ceased
to exist"

Issue: W/N Proclamation No. 427 is constitutional

Held: Yes, as the commander-in-chief or as chief executive the president, in declaring a


state of rebellion and in calling out the armed forces, was merely excercising a wedding
of her executive power, vested on the president by sec(1) and (18) of Art VII.
