PETITION

Petitioner by the undersigned attorney, and unto this Honorable


Court, respectfully alleges that:

1. On August 25, 1991, petitioner presented to the Register


of Deeds of Tacloban City for registration a deed of resale of a certain
parcel of land located in Avenida Rizal, Nagcarlan, Tacloban City
wherein LIZA MALIG was the vendor, and your petitioner, the vendee;

2. Said deed of resale on said date was duly entered in the


Entry Book of the said Registry of Deeds as Entry No. 21010101010
Vol. 10;

3. The deed of sale as thus presented, was accompanied by


the owner’s duplicate certificate of title, Transfer Certificate No. 78992
of the Register of Deeds of Tacloban City;

4. Duplicate owner’s copy of the title of this parcel of land was,


however, lost and is now beyond recovery, the circumstances were
brought by the destructive typhoon Yolanda as evidenced by an
Affidavit of Loss executed by your petitioner, a copy of the Affidavit of
Loss which was annotated under Entry No. 3103103030 on November
25, 2013 with the Registry of Deeds of Tacloban City is hereto attached
as Annex “A”;

5. In view of the above, the said Owner’s Duplicate Copy of


Transfer Certificate of Title No. 78992 registered under the name of
your petitioner must be deemed to have been lost or destroyed.

WHEREFORE, pursuant to law, and in view of the fact that said


Transfer Certificate of Title had been lost or destroyed, it is respectfully
prayed that, after due proceedings, an order be entered directing the
Register of Deeds of Tacloban City to issue a new duplicate certificate
of Title No. 78992, the same to be regarded as the original certificate
for all purposes of the law.

a resident of San Jose, Tacloban City, on oath, state:

1. That I as the Petitioner in the above-entitled case have


caused this PETITION FOR ISSUANCE OF NEW
OWNER’S COPY OF ORIGINAL CERTIFICATE OF TITLE
to be prepared; that I read and understood its contents
which are true and correct of my own personal knowledge
and/or based on true records;

2. That I have not commenced any action or proceeding


involving the same issue and specifically the same check/s
in the Supreme Court, the Court of Appeals, or any other
tribunal or agency and, to the best of my knowledge, no
such action or proceeding is pending in the Supreme
Court, the Court of Appeals or any other tribunal or agency,
and that, if I should learn thereafter that a similar action or
proceeding has been filed or is pending before these courts
or tribunal or agency, I undertake to report that fact to the
Court within five (5) days therefrom;

3. I am executing this sworn statement in compliance with


Section 5, Rule 7 of the 1997 Rules of Court.
