DEED OF REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

I, LARRY DE GUZMAN, Filipino, of legal age, single, and with

residence and post-office address at San Jose, Tacloban City, for and
in consideration of a loan in the sum of ONE MILLION AND TWO
HUNDRED THOUSAND PESOS (P 1,200,000.00), Philippine
currency, to me in hand paid by SEBASTIAN TIU, Filipino, of legal age,
single, and with residence and post-office address at Sagkahan,
Tacloban City, do hereby convey, by way of MORTGAGE, unto the
said (full name of mortgagee), his/her heirs and assigns, that certain
parcel of land, together with all the buildings and improvements
thereon, situated in Avenida Rizal, Nagcarlan, Tacloban City,
particularly described as follows:

“Bounded on the North by property of Rosita Narreta; on the East by

Avenida Rizal; on the South by property of the Heirs of Santos Loria
and on the West by a Canal, containing an area of Eight Hundred Fifty
Eight (858) square meters, more or less.”

of which real property I am the registered owner in accordance with the

provisions of the Land Registration Act, my title thereto being
evidenced by Original/Transfer Certificate of Title No. 78992 of the land
registry of Tacloban; PROVIDED HOWEVER, that if I, the said LARRY
DE GUZMAN shall pay or cause to be paid to said SEBASTIAN TIU,
his heirs or assigns, the said sum of ONE MILLION AND TWO
HUNDRED THOUSAND PESOS (P 1,200,000.00), within the period
of four (4) years from and after the execution of this MORTGAGE
together with the interest thereon at the rate of ten per centum (10 %)
per annum, then this MORTGAGE shall be discharged and of no effect;
OTHERWISE, it shall remain in full force and shall be enforceable in
the manner provided for by law.

day of May, 1996 in Tacloban City, Philippines.
