LEGAL NOTICE

Sub:- legal notice under Section 138 of the negotiable instruments Act, 1881 as amended up to date
for payment of cheque dishonored due to payment stopped by drawer

Dear Sir,
Under instructions and authority from our client, Mr. Ghanshyam Tripathi, s/o Mr. Raju Tripathi,
residing at DEF.I serve upon you the following notice of demand under sec 138 of the negotiable
instruments act,1881

That my client knows you, that you demanded a friendly loan of Rs.1,00,000 from my client on
01/01/2021. My client provided you the said amount.

On 05/03/2021,my client demanded the said amount to be returned on which thereafter you
issued a cheque of . 1,00,000/- dated 10/04/2021 bore No. 12345 and was drawn on Federal Bank,
Rajanakunte Branch, Bangalore

My client deposited the same in his HDFC Bank Account (Jayanagar Branch), Bangalore. On
15/04/2021, he received advice memo dated 15/04/2021 from his bank stating that the abovesaid
cheque has been dishonoured due to ‘Payment stopped by Drawer’.

My client states that you have issued the above said cheques only with an intention to cheat my client
which amounts to an offence punishable under section 138 of Negotiable Instruments Act.
 
Under the circumstances, we call upon you to pay of Rs. 1,00,000/-within a period of 15 (fifteen) days
from the date of receipt of this notice, failing which our client will be constrained to take legal action
against you in a court of law for an offence punishable under section 138 of Negotiable Instruments Act
for which you will be liable for all costs and consequences

This is without prejudice to all other legal rights and remedies available to my client for the above stated
purpose.
