WORKING WOMEN’S RIGHTS FOR
MATERNITY BENEFITS
• Labour law enacted by parliament in 1961
• Protects right of working women to take leave for
child birth
• Guarantees women for
– Keeping job
– Her seniority
– And other benefits
• Extent of act
– All establishments where >10 persons employed
– Does not include employees covered under Employees
state insurance (ESI) for certain period and after child
birth
WORKING WOMEN’S RIGHTS FOR
MATERNITY BENEFITS
• Benefit period
– Average daily wages up to six weeks and six weeks after her
delivery
– Additional medical bonus of Rs.1,000/- if no prenatal and post
natal care provided by employer
– Six weeks immediately followed by miscarriage on production of
proof with average daily wages
– 1 month for illness arising from pregnancy, delivery, premature
birth, miscarriage on production of proof
– After returning on duty additional two 15 minutes nursing
breaks
– Employer must maintains records for these leaves
(imprisonment for 3 months to 1 year / fine up to Rs.5,000/- or
both for violating law)

MATERNITY BENEFITS
• Restriction of work
– Employer is forbidden to employ woman for six weeks
immediately after delivery
– Upon request employer can exempt her from work with
arduous nature / any work interfering with her pregnancy
or normal development of fetus / adversely affect her
health
• Death during pregnancy
– Death during pregnancy – period up to her death
– Death after pregnancy (child is alive) – entire period of six
weeks after pregnancy
– Death after pregnancy (with child) – till the period of death
of child
