Module 8

1. Santi's remedy is reformation, which entails changing some parts of the contract's
provisions. The act of amending a written contract when one of the parties can show that
the real contract differs from what was agreed upon is known as reformation of the
contract. An annulment is not applicable since it entails the termination of the entire
contract. Because Shanti received a loan for the contract of sale, an annulment may
result in the entire transaction being canceled, which is not.

2. In all cases when the exchange is agreed or repurchase valuables from the buyer, the
right of repurchase applies. Buyers might refer to transactions involving real estate,
equipment, or insurance. To encourage sales or minimize concerns, a seller will
frequently offer to repurchase the product. In the absence of a clear contract, the right
can be exercised within 4 years from the date of the contract, or within the period
specified in the contract, but not more than 10 years.

3. In terms of her own share, Ena cannot ask Ana, Bana, Cana, and Dana to repurchase
the entire property. Each seller, who may have sold his or her share separately, has the
option to redeem his or her share on his or her own.
