Frommonth 7 to month 12 after Commencement, Date - 80% of replacement cost 3, From month 13 to month 24 after Commencement Date - 50% of replacement cost 4, From month 25 to month 36 after Commencement. Date - 20% of replacement cost. b) Thereplacement cost shall be the quantity ofthe paint TE/TEShyne and costs of labour only required to replace the area of Paint Failure, at the time of the lodgment of claim. The labour rate willbe determined bythe Companyand itwill be a reflection of the current prevailing market labour rates and the same will not be disputed by the Customer, atany pointof time, The labour rate may be determined on the basis of a per ‘sq.ft. rate or on a daily wages rate. The Customer will beliable forthe balance costs, which are not ‘Company's obligations, as indicated above. The ‘maximum liability of Company ifany, shall never ‘exceed the limits as set out in a) and b) above ©) The Company will notbe liable for any indirect or ‘consequential loss or damages to the Customer. The ‘Customer's exclusive and sole remedy under this Warranty shall be as mentioned herein this clause EXCLUSIONS The Warranty will cover only manufacturing defects of TE/TE Shyne and will not cover any defects arising out of factors out of control of the Company, including but not limites to: a) Paint Fallure due to structural defects and damage of film due to high abrasion of the surface with furniture, nails orothersharp objects bb) High alkalinity, waterleakage and seepage within the building structure and continuous dampness of the surface ¢)_ Paint applied ona surface which is contaminated, improper painting system followed or inadequate Ccuringtime for the paint film to dry d) Usage of improper shade recipes or incorrect bases fortintingcolours ) Natural calamities such as earthquakes, cyclones, ete, ) Failure or defects in the structure or previous coating 8) Vandalism h) Acts of God i) Abuse or negligence by the Customer J). Causes other than defects in TE/TE Shyne k) Normalwearandtear 1) Anyactor omission on the partofthe Contractor/Painter causing TE/TE Shyne or the application of TE/TE Shyne tobe defective by any means CLAIMS AND REPAIRS 2) Anyclaim made in terms of this Warranty shall be made within 30 days of the consumer discoveringany detect, damage o failure which gives rise toa claim b) Theconsumershall forthwith notify the Company of theclaim providingfulldetails thereof and shall setout the basis on which he believes that the Companys liable in terms ofthe Warranty. The Company reserves, the rightto carry outinspections of the paint TE/TE Shyne application process, inwhich TE/TE Shyne's alleged to have flledand to perform any tests in respectthereof and may doso ether itself or by means of any personnnominated by't-Priorto such inspection ortesting, the Customer shall notbe entitled to perform any repairsto or remove or tamper with any partof the pain, TE/TEShyne ©) The Company shalluse its bestendeavours to ensure thatthe paint required for repairs's available as soon as possible atthe place where the repairsare tobe carried out, butdoes natassume Liability for delayin this respect 6) The Company, nits sole discretion shall be entitled to 41. Control/monitorre-painting which ito be carried out inaccordance withallits specifications and instructions;and 2. Appointa contractor and/or approve the contractor appointed by the Customer ©) This Warranty disclaims any liabilities, contracts, tort orotherwise including negligence andstitliablty and the Company makes no Warranty or merchantability orof fitness for any particular purpose whatsoever for TE/TE Shyne. There are no warranties expressed orimpiied under law, which extend beyond the Warranty setoutherein 4) fany dispute arises between the Company nd the Customer, in respect ofthe above Warranty, neither shall commence any court or arbitration proceedings relatingto the dispute, unless they have first complied through mediation 8) Incase of any disputes, thesameis subjectto exclusive Jurisdiction of the courts of Mumbai h) The facts and al matters concerning any dispute wil be kept confidential by both the Customerand the Companyatalltimes
