INTRODUCTION:

The Legal Cell Section has been constituted by the Commission vide its order
dated 26.8.1995. The Legal Cell is headed by Head of Legal Cell, who is a retired
District Judge. Cases filed by the applicants/petitioners before different Courts pertaining
to various recruitments against the Commission are dealt by the Legal Cell. Judgments
received from all State Public Service Commissions & U.P.S.C. having a bearing on the
role and functioning of the Public Service Commissions have been compiled by the Legal
Cell and brought out four volumes of Compilation of Judgments so far.

The Commission appoints Advocate as proposed by the Head of Legal Cell for
the cases filed before various Courts against the Commission. Vakalath along with
related documents will be handed over to the concerned Advocates. Thereafter, the Brief
facts of the case which has been approved and signed by the Secretary will be collected
from the concerned Branch and the same will be sent to the Advocates for preparation of
draft Reply Statement. On the basis of the brief facts the Advocate prepares the draft
Reply Statement and forward the same for the approval of the Commission. Draft Reply
Statement as corrected by the Head of Legal Cell, approved and signed by the Secretary
will be filed before the Courts through the Advocates before the concerned Court. If the
Court requires any record regarding the case the same will be obtained from the
concerned Branch and will be produced before the Court through the Advocate.

The Commission will file writ petition and Special Leave Petition before the
Hon’ble High Court and Hon’ble Supreme Court challenging the orders of the Hon’ble
KAT and Hon’ble High Court respectively after obtaining the opinion of Head of Legal
Cell and orders of the Commission.

Interim order/final order of various Courts and other receipts will be submitted for
orders in the concerned files. Photocopies of the interim orders and final orders will be
forwarded to the concerned Branches for their information and to take necessary action in
the matter.
 Four volumes of the Compilation of Judgments have been already prepared and
published by the Commission and the same have been hosted in the Commission’s
website.

Head of Legal Cell will furnish his legal opinion regarding various recruitments
and other matters pertaining to the Commission as desired by the Secretary and the
Commission. The daily court cases list pertaining to the Commission are obtained from
the Advocate and submitted to the Head of Legal Cell and the Hon’ble Chairman.
Monthly pendency statement is prepared every month and the same will be submitted for
kind perusal of the Head of Legal Cell. The cases pending before the various Courts
pertaining to the Commission are enclosed as Annexure-I.
