Dear Commissioner Annucci:

Recording Secretary As you know, NYSCOPBA members have been, and remain, on the front lines of the COVID-19
pandemic. As such, our members have a unique perspective into dangers and vulnerabilities of
DOCCS’ correctional facilities. Given recent developments within our State and variants of the
Treasurer virus expressed below, NYSCOPBA now calls upon the Department to temporarily suspend
Frank Gilbo visitation at its correctional facilities, or alternatively, to impose more stringent safety measures
on visitors, contractors, and visitation areas in order to slow the spread of COVID-19.

reported that 7,831 staff members and 7,995 incarcerated individuals have contracted COVID-
19. Over the past four months, DOCCS has implemented safety requirements for employees,
including a requirement that employees provide proof of vaccination against COVID-19 or

transmittable Delta COVID-19 variant. Cases have risen 10-fold since early July, and 95 percent
of recent positives in New York State were the Delta variant. A winter surge of the Delta variant
is now underway, and a new variant of concern, Omicron, is rapidly spreading. These

developments resulted in Governor Hochul declaring a state of emergency and the New York
Central Region State Department of Health Commissioner’s December 10, 2021, Determination requiring

safety measures by DOCCS with respect to correctional facility visitation.

Vice President, As a result, NYSCOPBA calls upon DOCCS to implement greater measures for the protection of
Western Region staff and incarcerated individuals, including the suspension of visitation to State correctional

facilities, or alternatively, a health and safety policy that requires visitors and contractors to
provide proof of vaccination or a negative COVID-19 test prior to entry. Additionally,

Temporarily shuttering visitation, or alternatively implementing further safety measures for
visitors and contractors will help slow the transmission of COVID-19 within, and ultimately
outside of the State’s prisons. It is our hope that we can work together with DOCCS to provide
prospective and implement these changes to visitation immediately.
