OBJECTIVES OF THE LECTURE

• To identify the powers vested in the police officers in conducting search


• To identify and examine the key provisions governing the police powers to
conduct search on persons
• To distinguish the various types of search on persons

IMPORTANT PROVISIONS GOVERNING
SEARCH ON PERSONS
• Do the laws vested the powers in the enforcement officers to conduct search on persons?
• Revisit the case of Ghani & Ors v Jones [1969] 3 All ER 720
• Search on persons without warrant may conducted by virtue of Sections 17, 20 and 22 of
the CPC.
• Take Note of Section 20A CPC: Regulating the procedures of search on persons.
• The above provision is to be read together with the Fourth Schedule of the CPC.
• Please take note of the overriding general objectives and the general conduct of the search
which are encapsulated in the Fourth Schedule of the CPC.

TYPES OF SEARCH ON PERSONS

• Please refer to Para 1 of the Fourth Schedule of the CPC and examine when can search on
persons be conducted
• The following are the 4 types of search on persons that can be conducted:
• Pat down search
• Strip search
• Intimate search
• Intrusive search
• The above types of search are recognised in the case of Mostafa Lesanibaroogh Ebrahim
and Rasoul Ahmadi Nematollah v PR [2017] 1 LNS (Legal Network Series) 515

• Please take note that they are different procedures governing each type of
search above.
• Take note: PP v Bayati Heider [2014] 2 CLJ 915
• However, for every type of search conducted, it must be complied with
Section 20A of the CPC read together with the Fourth Schedule of the CPC.
• The above case also emphasis the need to prepare a search list when
conducting search on persons.
