LIABILITY RELEASE, ASSUMPTION OF RISK AND ARBITRATION AGREEMENT

LIABILITY RELEASE – By attending the [event] [“Event”] with Host ["Host"], I acknowledge that it
is not without risk. I agree that the Host and its heirs, agents, employees or assigns will not be
held liable for injury, illness, accident, emergency, death or other related problems arising from
the Event. I also agree to hold Host and its heirs, agents, employees or assigns harmless in the
event I suffer personal property theft, damage, or loss while attending the Event.

ASSUMPTION OF RISK – As a participant in the Event, I acknowledge that I am expected to be in

normal health and am willing to be responsible for my own actions. While the Host has taken
reasonable precautions, I recognize and acknowledge that the Event is not risk-free. I
acknowledge that my participation in the Event constitutes an awareness, acceptance, and
assumption of these risks.

JURISDICTION AND ARBITRATION - The laws of [state] govern this Agreement without regard to
conflicts of law provisions. I consent to the exclusive jurisdiction of the state and federal courts
sitting in the state of [state]. All unresolved disputes arising under this Agreement shall be
submitted to arbitration in [state]. The arbitration shall be conducted under the rules then
prevailing of the American Arbitration Association. The arbitrator's award shall be binding and
may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the
foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $5,000.

KNOWING AND VOLUNTARY EXECUTION – I have read and fully understand the contents and
legal ramifications of this Liability Release, Assumption of Risk and Arbitration Agreement. I
understand that this is a legally binding and enforceable contract and I sign it of my own free
will. I agree that if any portion of this agreement is found to be void or unenforceable, the
remaining portions shall remain in full force and effect.
