Canadian Marketing and Advertising Law (MKTG 4010) – Term Assignments: Essay and

Group Presentation

Part 1 - Essay
Value: 15 % (Papers will be marked out of 30) Due Date: Nov. 3rd.

Working in groups of 2 students, choose one of the following topics and in essay format, with
proper case and statute citations, source citations (APA format) and list of references (APA
format), provide a thoughtful response to the questions asked. Do your research and add your
reflections.

1. Length of paper: maximum 4 pages double spaced, not counting the cover page and
references page. Font: Times New Roman, 12. MS WORD format only.

2. Marks will be given for content (sound research, originality and analysis) and for style and
presentation (including correct spelling and grammar, the coherence and organization of
your argument, clarity of communication, and proper use of in-text citations and a
references page in APA style). Please use the services of the writing lab and of the library
should you need assistance. Note that Humber librarians and legal librarians are available to

3. Please submit your paper in Word format (no Pages or other formats please) via
Blackboard assignment drop box by the due date. Marks will be deducted for late
submissions (5 marks per day). Papers will not be accepted if more than 2 days late.

TOPICS:

A. Discuss the legal and ethical issues related to advertising to children. How effective are the
current regulatory and legal frameworks? What issues do you still see in this area of
advertising and marketing law? Provide specific examples from the advertising world and
discuss key cases on this topic. What recommendations would you make for further steps to
address these issues?

B. With the growth in environmental concerns among consumers, green marketing is a


growing trend. Describe what green marketing is and discuss the legal challenges that are

accompanying this growing movement in advertising and marketing. Examine the main
responses regulators and the industry have come up with to date and assess whether further
steps need to be taken to ensure effective oversight in this area.

C. As digital technologies continue to develop and frontiers such as AI move into the main
stream, consider the opportunities for business versus the challenges this raises for
lawmakers and regulators. How well is the law keeping up? Where are the areas of concern
from a consumer and societal perspective? What are the best practices that are emerging
and what are your recommendations for going forward?

D. An original topic of your choice in the area of Canadian Advertising and Marketing
Law. Some areas to consider may be:

 the impact and effectiveness of privacy laws in the context of online advertising and
social media;
 legal issues raised by online consumer influencers;
 class action lawsuits and their impact on advertising and marketing and on business
in general;
 explore the legal issues for advertising and marketing in a particular sector such as
Natural Health Products, Alcohol Products, Sports, etc.;

NB: Please send me a short proposal by course message in Blackboard on or


before Oct. 1st detailing your original topic. All self-defined topics MUST be pre-
approved to be accepted for submission.

Part 2 – Group Presentation


– In-class Group Presentations Based on your Group Essays – to be presentation ready for
Nov. 23, 2021.

Value: 10% of term mark.

Convert your group paper into a five minute group presentation that knocks our socks off. The
group presentations will be live via Collaborate Ultra. The rules and the rubric for this
presentation will be distributed soon.
