INTRODUCTION
The pendency of the ever-lasting cases before the Indian courts and the ineffectiveness of the
judicial system to deal with the same has been haunting in the present times. Even though there
have been a boom of the newest systems like the ADR (Alternate Dispute Resolution) and the
scrapping of redundant laws, there has been a conundrum regarding the need for application of
Artificial Intelligence to deal with the situation. India, being the fastest growing democracy on
one side and the most densely populated country on the other, has had a shortage of resources,
efficiency and infrastructure to deal with this issue.
The courts in India have already shown some advancement in the justice delivery system, with
one of the milestones being digitisation, the adoption of the fastest emerging Artificial
Intelligence may help in ensuring sustainable justice delivery and reduce the backlog of pending
cases. Even though the process of litigation and justice delivery is sensitive and subjective, the
basic matters like grant of bail, release of offenders on parole by the help of A.I. has been in
vogue in the U.S. and Canada. In the similar fashion, India too is equipped to allow the
introduction of the A.I. into mainstream justice delivery. Some basic steps could be the service of
processes, summons, steadily moving forward to the evaluation of evidence.
Even though there are counter-arguments to the use of A.I. with the basic concern being that the
machines and artificial methods cannot solve the intricacies of decision-making and lacks the
definition of subjective analysis, nevertheless, these may help the judges in the decision-making
process by giving calculated and unbiased opinions and thus ensuring that justice is not crippled
in the process of handling large number of cases.
