Gentlemen:

I write to formally file my claim for settlement of the

damage that my motor vehicle sustained in an accident that
occurred on 23 October 2020.

In retrospect, I am the registered owner of a motor vehicle

with the following make and details:

Body Type: : Sedan
Brand : Honda
Year : 2018
Series : Civic
Plate No. : NDI 7970

(“SUBJECT VEHICLE”)

The subject vehicle is covered by Polcy No. V0850677 by

Malayan Insurance.

On 23 October 2020, at around 3:55 pm, my driver, MR.

ROMMEL BAGTAS, (“MR. BAGTAS”) was driving the subject
vehicle on his way to Olongapo City to run errands with my
father, ENGR. MANUEL M. ACOSTA. While the subject
vehicle treaded the curved uphill path of Brgy. Barretto,
Olongapo City, a Nissan Navarra (with Plate No. AAO-3208)
suddenly tried to overtake but, in the process, sideswiped the
former’s front left portion with the latter’s rear portion. The
Nissan Navarra was being driven by a certain MA. CORAZON
A. VALERIO, (“MS. VALERIO”) and registered under the name
of JELANE GAY E. CHUA.

The accident was duly reported to the Philippine National

Police-Traffic Enforcement Unit (PNP-TEU), who rendered a
report on the matter, 1 and obtained the necessary registration
papers and licenses of the persons involved.2

Immediately after the accident, I coordinated with

Malayan Insurance-Olongapo Branch, which immediately
provided mem with the necessary forms that I should
accomplish and a claims checklist.

Further, I also coordinated with Honda to assess the

damage done, which according to their estimate, is in the
aggregate to PhP68,761.28.3

I also caused an independent body repair shop, Perfect

Finish-Olongapo City, to estimate the same damage. Their
estimate is substantially lower at PhP56,000.00.4

Considering that our family urgently needs the subject

vehicle, especially in this time of pandemic, we decided to have
the same repaired by Perfect Finish, which started the repair on

30 October 2020. The same is expected to be done on/or before
8 November 2020.

Based on the foregoing, I would like to request a claim of

settlement/reimbursement of PhP56,000.00 representing the
cost of repair by Perfect Finish-Olongapo City for the subject
vehicle.

For coordination and to expedite settlement, I am also

authorizing ATTY. RICHARD JOSEPH C. DORIA, ATTY.
ANGELO FRANCISCO F. PIEDRA and/or any other lawyer
or associate of LIBRA LAW (Libarios and Partners) as my duly
authorized representatives for purposes of this matter. Said
