Question:
Php 30, 0000 as rewards for damages, do you agree that is enough to compensate the
damages done? If yes, how can you justify such amount?

Answer/Opinino:

I do agree that the amount shall be enough for the reason that the supreme court in the
case of AGABON v. NLRC ruled in the negative in the issue whether the petitioners were illegally
dismissed; it also stated that the petitioners’ dismissal shall be considered for the just cause.
From the foregoing, there had been an abandonment of the employment and the employee
were already working for another employer. In dismissing an employee, the provisions of the
law mandates that not only the existence of a just and valid cause but in the same way enjoins
the employer to provide the employee the opportunity to be heard and to defend themselves.

The act of abandonment shall be the deliberate and unjustified refusal of an employee
to resume their employment. It shall be considered as a form of neglecting the duty, therefore
there will be a just cause for the termination of the employment by the employer

Going to the main notion, if those persons shall be given more the Php 30, 000 is almost
analogous, if not it will be totally equal for not having been given or received for as a separation
pay. The law mandates that if an employee shall be terminated because of a just cause it may
establish that the employee had violated the contract of the employment and the act of paying
the separation pay will be considered as a reward for the violation.
