objection regarding valuation of suit

the policy underlying Section 21 and 99 cpc and Section 11 ofd the Suits Valuation Act is the same,
namely that when a case had been tried by the court on the merits and judgment rendered. it should
not be liable to reversed purely on technical grounds, unless it has resulted in failure of justice and
policy of the legislature has been treated objections as to jurisdiction both territorial and pecuniary as
technical and not open to consideration by an appellate court unless there had been a prejudice on
merits

this is the effect of the provision of Section 11 , suits valuation act 1887 . these provisions are similar to
those contained in Section 21 of the code. but once it is found that valuatin is proper the court is
entitled to pass a decree for an amount even higher than its pecuniary limits. sucnh decree is legal and
free for vice. howeve if there is any amendment
