definitions and legality
Like handwritten signatures, electronic signatures are a legal concept that captures the intention
of the parties bound by the terms of a signed document.
Electronic signatures according to the European

eIDAS Regulation
Regulation No 910/2014, known as eIDAS, in force since July 2016, establishes the legal
framework for electronic identification systems and trust services applicable throughout
Europe.
One of the main objectives of the eIDAS Regulation is to facilitate electronic

transactions within the European Union and create a single digital market with free
interaction among member states.
This Regulation recognizes three types of electronic signatures:
Simple electronic signature

“Electronic data is attached to other electronic data or logically associated
with them, used by the signatory to create a signature.”
Advanced electronic signature

“electronic signatures that meet the following requirements:
· be uniquely linked to the signatory;
· allow for the signatory to be identified;
· created using electronic signature creation data that the signatory can use,
with a high level of confidence, under his/her exclusive control, and
· be linked to the data signed by the same in such a way that any subsequent
modification of it is detectable.”

“An advanced electronic signature that is created by a qualified electronic
signature creation device and is based on a qualified electronic signature
certificate.”

The legality of electronic signatures
Applicable legislation in the European Union

The 3 types of electronic signature - simple, advanced, and qualified - are legal and, as
we have mentioned before, are regulated in the European Union by the eIDAS Regulation.
Because it is a regulation rather than a directive, eIDAS is directly applicable in all member
states.
“An electronic signature will not be denied legal effects or admissibility as

evidence in judicial proceedings for the mere fact of being an electronic
signature or because it does not meet the requirements of a qualified
electronic signature.”

In Spain, Law 6/2020 regulates trust services and their legal effectiveness as a supplement
to the provisions of the eIDAS Regulation.

Applicable legislation in the USA

Two laws establish the legality of electronic signatures in the United States. It has been
decreed that it has the same legal validity and effect as a handwritten signature on paper:
Uniform Electronic Transactions Act (UETA, 1999)
Electronic Signatures in Global and National Commerce Act (ESIGN, 2000)

Internationally applicable legislation
With respect to the rest of the countries that are outside the European Union, it is
important to bear in mind that each country has its own regulations. However, in recent
years, the vast majority of countries have seen progress in electronic signature regulation,
admitting its use and recognizing its legal validity.
Finally, at the international level, there are different initiatives that establish a basic
framework for the use of electronic signatures, such as the OECD, UNCITRAL, and
International Chamber of Commerce (ICC) guidelines.

How Biometric Technology Works
The technology of our biometric electronic signature solution allows us to capture the
following biometric data of the signatory when signing any document:

the speed with which it is written,
the pressure exerted with the finger or a
pen on the device used to sign (mobile,
tablet, laptop, or desktop computer), for
the devices that allow it.
From these variables, we can obtain others,

such as the time it takes to finish the stroke,
how many times the finger (or the pen)
separates from the field for the signature,
or the angle at which each stroke is made,
among other data.
All these data serve to uniquely identify
the signatory and are stored and encrypted
with a public and private password.
NOTE: We do not store any advanced electronic signatures, but rather each one is created uniquely for each document.
The substantiating document with electronic evidence

During each signing process, we collect a series of electronic evidence that offers
additional information about the context in which the signature was made. We include this
evidence in the substantiating document, or audit trail, witch contains:
A unique identifier of the transaction.

Name of signatory.
Their email address or phone number.
IP address and geolocation.
Authentication history.
Chain of custody (e.g. sent, seen, signed, etc.).
Official timestamp.
Complete status.
We guarantee the integrity of the electronic evidence through an official time stamp*:
we guarantee that the data of the substantiating document, as well as the signature itself,
have not been altered after signing.
