PETITION

Petitioner, by herself, unto this Honorable Court most respectfully

states that: -

1. I, the Petitioner, is Filipino, 29 years old, single and has the legal
capacity to sue and be sued and a resident of _________ where I may
be served with summons and other processes of this Honorable
Court;

2. I am the PATERNAL AUNT of the minor, _________. Minor is

presently living and residing with me at the address stated above,
was born on (Birthday ng Minor) in (Place of Birth ng Minor). Copy
of Certificate of Live Birth of the minor is attached here marked as
ANNEX “A” and made an integral part of this Petition;

3. The Minor’s mother died of (cause of death)on May 3, 2016 and her
father died in a hit and run on January 10, 2021. Attached here is
the copy of her mother’s and father’s death certificate marked as
ANNEX “B” and ANNEX “C” respectively;

4. The Minor has her own personal savings account with (Bank) with
SAVINGS ACCOUNT NUMBER __________ where the Social Security
Pension (SSS) of her parents that she recieves as the beneficiary is
deposited amounting to _________ each month. Attached herein is the
Copy of Passbook for Savings Account Name S______ and Account
Number _____________________ marked as ANNEX “D”;
 5. Due to the minority of the MINOR and the untimely death of her
parents, there is a dire need to assign me as the guardian of her
Person and Estate since the MINOR is already under my care for
11 months now since the death of the father of the Minor in
January. It is highly convenient and in the best interest of the Minor
that the Guardianship be granted to me who is already caring for
her;

6. The MINOR has no living relatives, by blood or by affinity, who have

expressed interest in taking the responsibility of caring for the her,
and no one has interposed objection to the petition for
guardianship of the minor;

7. Attached are the Certificate of Live Birth of mine and of the Minor’s
father marked as ANNEX “E” and ANNEX “F”, respectively, to prove
my relationship with the Minor as my niece and her father as my
brother.

WHEREFORE, the foregoing premises considered, in the best

interest of the MINOR, it is most respectfully prayed of to this Honorable
Court that after due notice, and hearing, that a judgment be rendered
appointing me, _____, as Guardian of the Person and Estate of the minor
______.

Other relief and remedies just and equitable under the premises are
likewise prayed for.
