Dear Sir or Madam,


Enclosed is an I-129 petition for (xxxxxx Your Name), who has been contracted by (xxxxx Petitioner
name), as
Petitioner/Agent and Employer for a three-year period commencing (date xxxxxxx) . In accordance
with 8 CFR 214.2(o)(2)(iv)(E)(2), I, (xxxxx Petitioner
name), will act herein as Beneficiary’s Designated Agent for immigration purposes only, on behalf of
the other employers engaging the Beneficiary for the period listed on the petition.

Best efforts have been made herein to give the most current ‘snapshot’ of Beneficiary’s itinerary,
known as of the date of this filing. However, in accordance with 8 CFR 214.2(o)(2)(iv)(D), this
petition is itinerary based and the petitioner may add additional engagements during the approval
period.

We submit the following elements, in accordance with CFR 8 § 214.2(o):


1. Per 8 CFR 214.2(o)(2)(i), I-129 with attached $325 filing fee.
2. Per 8 CFR 214.2(o)(2)(ii)(B), a summary of terms of the oral agreement between the petitioner
and the alien beneficiary, under which the alien will be employed.
3. Per 8 CFR 214.2(o)(2)(ii)(C) and 8 CFR 214.2(o)(2)(iv)(E)(2), providing evidence and explanations
regarding the nature of events during the three-year period of engagement:
i. Explanation of the nature of employment.
ii. A complete itinerary of the events specifying the dates of each employment, the names and
addresses of the actual employers, and the names and addresses of the establishments, venues, or
locations where the services will be performed.
iii. Contract between the employers and beneficiary, signed by the agent/petitioner.
4. Per 8 CFR 214.2(o)(2)(ii)(D) and 8 CFR 214.2(o)(5), Consultation letter by the American
Federation of Musicians attesting to Beneficiary’s stature as an O-1B alien of extraordinary ability in
the performing arts.
5. Per 8 CFR 214.2(o)(3)(iv) Evidence Criteria for an O-1 alien of extraordinary ability in the arts
(section B- three out of six is required, four categories chosen):
i. Per 8 CFR 214.2(o)(3)(iv)(B)(5), recommendation letters from renown musicians and presidents in
reputable organizations, showing that the beneficiary has received significant recognition for his
achievements and extensive support for her O-1B visa application.
ii. Per 8 CFR 214.2(o)(3)(iv)(B)(1) and (3), publications, testimonials, advertisements, programs,
photos, on-line and newspaper articles, reviews and official statements, showing that the beneficiary
has performed, and will perform as a xxxxxx player in international and local concerts, festivals,
recordings, and productions, for band-leaders, companies, organizations and establishments which
have a distinguished reputation.
iii. Per 8 CFR 214.2(o)(3)(iv)(B)(2), reviews, newspaper articles, scholarships, awards
recommendations, thank-you and acknowledgement letters, showing that the beneficiary has
achieved national and international recognition for achievements.
iv. All supportive material for sections 8 CFR 214.2(o)(3)(iv)(B) (1), (2) and (3) above (i.e. reviews,
advertisements, articles, etc.) is included in the “Supportive Material” section and is classified by
name of employer first, and by the specific Evidence Criteria, second, as detailed in “Table of
Contents”. This was done to create better coherence of the nature of work that was done in the past
and will be done in the future, for that employer.
6. Copy of Beneficiary’s passport and biographical data, including the I/94 section.
