04 Particulars of the order/ By the impugned judgment and decree, the
Judgment and decree regular civil appeal filed by the Caveatees
Brijratna Kabra and others has been
dismissed confirming the judgment and
decree dated 30.8.2014 of the Court of Civil
Judge, Class-I, Gadarwara, whereby the relief
of cancellation of licence, grant of
possession and permanent injunction had
been granted in favour of
caveators/plaintiffs.
CAVEAT
The Caveators named above respectfully begs to submit as under :-

1. Subject Matter in brief : The suit for declaration, permanent injunction


has been filed in respect of cancellation of licence, restoration of
possession and permanent injunction against the caveatees/defendants
before the trial court, the judgment and decree dated 30.8.2014 has
been passed in favour of the plaintiffs against which the regular civil
appeal was filed by the defendants caveatees, the same has been
dismissed by the impugned judgment and decree of the court below
dated 10.9.2018 confirming the judgment and decree dated 30.8.2014.

2. That, it is expected that the caveatees may prefer Second Appeal under
Section 100 of the Code of Civil Procedure to the Hon'ble High Court and
may pray for interim relief.

3. That, the caveators have dispatched a notice of caveat by registered post


with acknowledgement due on the person by whom the Second Appeal
is expected to be filed, furnishing particulars regarding the order as
detailed hereinabove, in respect whereof the caveat is filed. A receipt
evidencing dispatch of the caveat is annexed as Annexure A-1.

5. It is, therefore prayed that in the event of the caveatees preferring such

(3) Any other orders in the interest of justice may kindly be passed; before
granting interim relief.
