An effective criminal justice system is capable of investigate and adjudicate criminal offenses
effectively and fairly, while ensuring that the rights of the suspect and the victim is protected.
Crime rates and recidivism is a commonly used metric to assess performance of the criminal
justice system. The basic principle underlying the criminal justice system in Malaysia is that
the accused is innocent until proven guilty. In line with this principle, the Malaysian criminal
justice system provides various protections to protect the accused. Some legislation, such as
the drug and corruption, contain certain statutory presumptions which can be prosecuted
against the accused. Therefore, when a person is charged with an offense under this law, the
burden is turned to the accused to refute the presumption. The criminal justice system in
Malaysia also ensures that a person who commits an offense is punished accordingly by law.
It is also in the public interest that the police force maintain law and order in the country. The
duty to investigate an offense is with the police, and the duty to decide whether a person
should be charged lies with the Attorney General, who is also the Public Prosecutor. The
lawyer bears the responsibility to defend the accused person and the court adjudicates. People
generally obey the law, but it is also true that everyone breaks the law sometimes and some
people often violate it. Legal compliance is never complete.
