Right of unpaid seller

Introduction
The Sale of Goods Act of 1930 also addresses the rights and obligations of an underpaid seller, as
well as the rights and duties of the seller and buyer. It is the buyer’s responsibility to pay the price
for the items supplied; if he fails to do so, the seller is left unpaid. In this article, we will look at the
obligations of an underpaid seller under the Sale of Goods Act of 1930. Unpaid vendor is someone
who sold products but did not obtain complete payment for them. In this case, the underpaid seller
receives half of the payment, while the other half remains unpaid. According to the Sale of Items
Act of 1930, an unpaid seller is one who has not been paid the entire amount of the goods sold or
who has received a bill of exchange or other negotiable instrument as conditional payment but has
not met the condition. Section 45(1) of the Sale of Goods Act of 1930 defines an unpaid seller. The
rights of an unpaid seller in following are Right to lien, right to stoppage transit, right to re-sale,
right to sue.
