FINAL AUTHORISATION AND CONFIRMATION GIVEN TO ABC STUDY LINKS BY DEVIKA

KRISHNAN ON 25th SEPTEMBER 2021 FOR THE ADMISSION & VISA ASSISTANCE FOR MY THREE
YEAR VOCATIONAL TRAINING NURSING PROGRAM ADMISSION IN ANYONE OF THE NURSING
SCHOOLS IN GERMANY

I, DEVIKA KRISHNAN D/o Mr. Krishnankutty K K, holder of Indian Aadhar No. 431443003097
aged 17 years, residing at Kudilil House, Periappuram P.O , Pampakuda, Ernakulam– 686667,
Kerala, India do hereby solemnly understand, affirm and declare as under:

1. I am interested in getting admission and studying in a Three Year Vocational Training

Nursing Program in any of the Nursing Schools in Germany.

2. I came to know about ABC Study Links through their Webinar advertisement in Social
Media and participated in it. After attending the Webinar, I am very much interested in
getting an admission and studying in a three years Nursing Program in any of the
Nursing Schools in Germany.
3. For that purpose I and my parents contacted ABC Study Links and requested their
professional help and support for me to get me a Nursing admission in Germany
including imparting information, Counseling and Visa Documentation etc. for me.

4. After getting proper counseling & Information and also verifying the authenticity of it
from various German Government websites, myself and my parents have decided to
appoint ABC Study Links as my official agent in India for this purpose.

5. I hereby authorize ABC Study Links (hereinafter referred to as ABC) to provide all
possible assistance and support to supplement my knowledge, which I gathered from
various sources, and help me to attain my Offer Letter / Admission Letter from any one
of the Nursing Schools in Germany for the three year Nursing Vocational Training
program and also provide me visa documentation, arranging accommodation in
Germany, travel assistance, Airport Pick up over there etc.

6. I confirm that I have sought the services of ABC after doing a thorough research
regarding the services provided by them from similarly placed people about their
efficiency, credibility, and also knowing the limitations of ABC as an overseas education
consultant operating within India and that while assisting me, upon my request and the
information given to me regarding this Nursing Diploma course will be purely based on
my own choice and current scenario, which is subject to change at any time.
7. I am aware that it is my responsibility to ascertain the accreditation, quality and
reliability of the Nursing School and the chosen program and also understand the
present scenario of study program for international students in Germany, the academic
and professional opportunities, risks involved, visa rules and regulations and
amendments, by referring to the various official web sites of concerned Nursing School
and country.

8. I am informed by ABC that I have to be in regular contact with ABC and must contact an
ABC officer who is dealing with my admission & visa processing at least once in a week. I
am also informed that if I am not able to contact the concerned ABC officer, I have to
send an email to the concerned officer for any information / details required.

9. I understand and accept that this Commitment Letter/Authorization Letter is valid for a
period of EIGHTEEN MONTHS from the date of signing, and during this validity period, I
shall not avail the services of any other Institution / Agency / Consultants / Person in
India and abroad, for my higher education abroad. I accept that if I breach this promise
or decide not to proceed further with the study program abroad, would like not to avail
the services of ABC any further or cancel the Commitment Letter/Authorization Letter,
then I shall be liable to give adequate compensation to ABC according to the terms
conditions mentioned hereunder.

10. I am aware that by signing this Commitment Letter/Authorization Letter all my previous
liaisons with similar consultants becomes invalid during the total Eighteen Months
tenure of this agreement, unless revoked in writing and signed by any one of the
authorized signatories of ABC such as The President, The Vice President or The General
Manager-Administration, after giving adequate compensation to ABC for utilizing their
services by me, their business loss and the time spent for me.
11. I fully agree that ABC has not given me any Promise / Guarantee for getting me an
admission in a Nursing School in Germany as it is purely depends upon passing Four
Levels of German Language examinations, which are A-1, A-2, B-1 and B-2 and also
passing the Nursing School and Hospital Interview from Germany in German Language.

12. I agree that ABC has not given me any promise to get me a German visa from German
Embassy / Consulate as it will be purely the discretion of the German Embassy /
Consulate, my documents submitted along with the visa application, my performance in
the Visa Interview etc..

13. I also agree that ABC has not given me any promise for getting me a Part Time Job / Full
Time Job in Germany, success in examinations conducted by Nursing school from time
to time and also the State Nursing Licensing examination conducted by the Health
Ministry at the end of a three year nursing study program.

14. I agree that ABC also has not given me any promise for my Stay Back visa after
completion of my study, Permanent Resident Visa, German Citizenship, Family Status,
Spouse Visa etc: in Germany as it is not my right to get the above mentioned benefits
but is purely the decision and discretion of German Government. I am well aware that
ABC does not have any control on the above mentioned facilities.

15. I am also aware that all the information given to me at the time of counseling regarding
the above mentioned facilities is purely based on the rules and regulations of German
Government / Nursing School at the time of admission and these rules and regulations
could be changed or amended at any time by the German Government / Nursing School.

16. I am aware that ABC and their partners in Germany are dealing with several Nursing
schools in different parts of Germany and sending students to them. I am confident that
they will put all their good efforts to get me an admission from any one of the Nursing
Schools in Germany. ABC has not given any promise to get me an admission in a
 particular Nursing school, city, province and region. It will purely depend upon the seat
availability and success of my video interview with the Nursing school and Hospital.

17. I am aware that Nursing Schools in Germany are offering free education and need not
be required to pay Tuition Fees for the entire study period of Three years from the
beginning of my Nursing Study program in Germany. The Nursing program consists of
2100 hours of classroom teaching and 2500 hours of Hospital and Health care facility
work / employment.

18. I am well aware that during the study period of the 3 year nursing program, I have to
work a minimum of 2500 hours in a hospital / health facility where I attend a video
interview, get selected and receive a work contract / offer letter. I will be getting a salary
/ stipend every month from the hospital / health facility I work with as per the Job
Contract signed with them. Normally it is around 1100 Euros every month during the
first year, 1200 Euros every month in the second year and 1300 Euros every month in
the third year.

19. I agree that ABC has not given me any kind of promise or Guarantee to get me any sort
of additional scholarships, free accommodation, free food or any other facilities from
the German Government / Nursing School / Hospital / Health Care facility, other than
the monthly salary / stipend mentioned in my work contract from the Hospital / Health
care facility.

20. I am aware that ABC has not promised me to get me a part time job or full time job in
Germany either during my 3 year Nursing study period or after completion of my
Nursing program.

21. I am aware about the climatic conditions in Germany, especially about the cold weather
in the winter season.

22. I am informed by ABC that, if due to any reason, my visa application get rejected by the
 Nursing School / Embassy / Consulate, all the money I have already spend money for the
expenses related to my four level German Language study- A-1 Level to B-2 Level, Its
examination fees, 10th and 12th certificate translation to German Language, Attestation,
courier it to Germany, Preparation of all the documents related to the visa, expenses for
the Embassy / Consulate Interview etc: shall be lost and I am ready to bear all the losses
related to the above mentioned.

23. I am informed by ABC that after successful completion of my 3 year Nursing course and
pass the State Nurse Licensing Examination and get a Nursing License, I will be able to
attend interview with any one of the Hospital / Health facility in Germany, get selected
and work full time in Germany as a State Registered Nurse.

24. I am also informed by ABC that after my studies in Germany, I will be getting Eighteen
Months Job Search Visa, Eligibility to get Permanent Resident Visa (PR), after successful
completion of my 3 year employment in a Health care facility in Germany, Eligibility to
get Citizenship after 3-4 year after getting PR. I am aware that the above mentioned
benefits are offered by the German Government and not by ABC and German
Government have the right to change / amend / withdraw this facility at any time and
ABC does not have any control over it.

25. ABC also informed me that I will be eligible to get all benefits offered by my employer /
German Government, during my full time employment with a Healthcare facility in
Germany such as Medical Insurance, Unemployment Insurance, Employment insurance,
Life Insurance, Monthly Children Allowance, Free Education to my Children in Germany
and Monthly Pension after retirement etc.

26. I undertakes to provide all genuine, correct and true information and documents in
relation with the application for the above said purpose and further agrees that, if at
any stage of processing of the applications, the concerned authorities / bodies / High
commission / Consulate in India and / or abroad, find that any information or document
provided by the client is false, forged, fabricated or illegal, for the above said purpose/s,
 ABC will be free to inform the concerned authorities like Police, Interpol or any such
bodies for further legal action/s against me, my relatives / friends, and ABC will be at
liberty to realize any loss or damage (goodwill / intellectual property, mental pain,
mental shock or financial loss) incurred to ABC, employees or agents from me, my
relatives / parents / guardians for such acts.

27. I was informed by ABC and I agreed at the time of registering with ABC about the total
approximate amount of money I am required to spend for this program as below.
Total Expenditure for this program is Rs.4,60,000.00 Approximately
1. Expenses to study 4 Level German Language and : Rs.1,50,000.00 Approx
B-1 & B-2 Examination fees
2. Service charges of German Application Center (GAC : Rs.1,80,000.00
(After passing A-1 or A-2 Level German Language =Rs.45,000/-
After getting visa stamped on passport =Rs.1, 35,000/-)
3. ABC Service Charge Rs.80,000 + 18% GST : Rs. 94,400.00
(At the time of Joining for this program Rs.23,600/-, After passing A-2 Level=23,600/-
After passing B-2 Level and before submitting the visa application=47,200/-)
4. Visa Application, Certificate Translation and attestation : Rs. 10,000.00 Approx
5. Flight Ticket (One way) : Rs. 35,000.00 Approx

28. REFUND POLICY OF ABC STUDY LINKS:

I am informed about the Refund Policy terms and conditions of ABC and I have joined
this program only after agreeing the given below terms and conditions.
1. If my visa application gets rejected first time, I agree to re-submit it once again. If my
visa application gets rejected second time also, then ABC agreed to refund me all the
service charges given to them except Rs. 11,900/- (Rupees Eleven Thousand Nine
Hundred only) as their Registration and Administrative Charges. I have no objection
regarding this.
 2. No refund will be given to me by ABC, if I decide not to proceed further with this
program and cancel this German Study Program without successfully completing my
German Language study and / or not submitting the visa application with all required
documents in time.
3. If my visa application gets rejected the second time also, then GAC will refund 250
Euros only out of the total 500 Euros paid to GAC, as per the agreement I signed
with GAC.
4. The money I spent for my German Language study and its examination fees are
given to external Institutes only and ABC does not have any role in it. So I have no
rights to get any refund amount from ABC for the money I spent for my German
Language study and examination.
5. The Non Refundable Visa application fees to be paid to German Embassy / Consulate
and I can expect no refund from them.
6. I am confirm that I am joining this Nursing Program with my own interest to go to
Germany and study Nursing. If my visa application gets rejected, ABC will not be
responsible for it in any manner and ABC does not have any responsibility to
compensate me for the time, money and energy spent for this program.

29. I am also aware that the German visa process is very complicated and lengthy and it
takes at least three to four months by German Embassy / Consulate. If I fail to submit
any of the documents required in time, I may not get my visa.

30. I am informed by ABC that I am not required to deposit 10,332/- Euros (Ten Thousand
Three Hundred and Thirty Two) as my Blocked Bank account in German Deutsche bank
for my one year cost of living before the submission of my visa application with German
Embassy / Consulate as I will be getting salary as per my work contract going to sign with
the Hospital / healthcare facility in Germany and it is sufficient enough for my cost of
living in Germany during my study.
31. I fully understand and agree that it is my duty to come and attend all the study classes /
seminars / awareness classes /visa briefing/ pre-departure briefing / counseling etc. and
to read and understand all the leaflets provided by ABC and do / behave / act as per the
directions of ABC without fail. ABC conducts all the above said value added services for
the better results and to avoid unnecessary allegations or confusions from my side
regarding any area or point which may not be known / familiar to me and could be a
possible dispute or stress in the future when I face any kind of issues or problems in
India or abroad.
32. I hereby undertake that if I am selected to Germany for study, I will obey all the Laws,
Rules, Regulations, etc. of Germany. I am also aware that any unlawful act/deed from
my part while in Germany, I will be punished as per their Law.

33. I agree that in case any dispute arises between me and ABC, then the matter will be
referred to the Arbitrator- Mr. Saju S Poonthodath, Advocate, Poonthodath House.
Santhi Nagar, Thevara P.O., Kochi -682 013. Adv. Saju S Poonthodath is jointly appointed
by me and ABC in Kochi, Kerala. All disputes shall be settled by final and binding
arbitration to be conducted by the Sole Arbitrator and in accordance with the provisions
of Indian Arbitration and Conciliation Act, 1996 to be conducted in Cochin (Kochi),
Kerala, India, in the English language. The common costs and expenses of arbitration,
including Remuneration to the arbitrator and related costs and expenses, shall be borne
by me and ABC equally in the first instance. The Award passed by the Arbitrator shall be
binding on both parties and the same shall be executed as a Decree in a competent Civil
Court, having jurisdiction. The Arbitrator, appointed as per this agreement, shall have
the right to award costs as part of the arbitration award, to the prevailing party.

I hereby declare that I have thoroughly read and clearly understood all clauses
mentioned in this Commitment Letter/Authorization Letter and I am signing this
 Commitment Letter/Authorization Letter with free consent and full awareness and with
the full consent of my parents / guardians in the presence of the following.

All the facts are true and correct.
