THIS AGREEMENT FOR LEAVE AND LICENCE is made and entered into at
residing at Lal Bahadur Shastri Nagar, Kandar Pada, Dahisar (West), Nr. Shiv
Mandir, Mumbai - 400 068, hereinafter called and referred to as “the LICENSOR”
mean and include her heirs, executors administrators and assigns )of the ONE
Colony, Borivali (West) ,Mumbai - 400 103, hereinafter called and referred to as the
Meaning thereof mean and include her heirs executors, administrators and assigns)
WHEREAS the Licensor is the lawful owner and absolutely seized and possessed
and/or Other wise well and sufficiently entitled to a room premises, along with
electrical fittings and other facilities attached thereto, situated at Lal Bahadur
Mumbai - 400 068, hereinafter called and referred to as “ THE SAID ROOM
for the purpose of Conducting Business of Selling of Consumer Dress Materials for
temporary period of 11 months, on Leave and License basis and hence the Licensee has
approached to the Licensor with a request to allow her to use and occupy the said room
premises for the Purpose of Business for a temporary period of 11 months on Leave and
license basis and the Licensor has conceded the request of the Licensee and allowed her
to use and occupy the said premises and considering his request, the Licensor has
granted permission to the Licensee to use and occupy the said premises on Leave and
License basis, hence they have reduced into writing, upon such terms and conditions
herein mentioned.
NOW THIS AGREEMTENT WITNESSETH UNDER:
The Licensor is the absolute owner of the room remises situated at Lal
Bahadur Shastri Nagar, Kandar Pada, Dahisar (West), Nr. Shiv Mandir,
Mumbai - 400 068 , and the licensor has allowed the Licensee to use and
occupy the said Room premises for Business purpose and the Licensee have
accepted the same for the purpose of residence of residence for a temporary
1. The Licensee have paid with the License or a sum Rs.15000/- (RUPEES
FIFTEEN THOUSANDE ONLY) being the security deposit amount for the due
and proper performance of this agreement (the Licensor do hereby admits and
acknowledge the receipt of the same) and such security deposit amount shall not bear
any interest and shall be refunded by the licensor to the Licensee immediately on
expiry of this agreement and/or earlier determination after adjustment of monthly
compensation or any other dues including the cost of loss or damage to the said
Room premises.
2. The Licensee shall pay to the Licensor a sum of Rs.1,800/- (RUPEES ONE
THOUSAND EIGHT HUNDRED ONLY ) being the monthly compensation
/royalty charges, for the use and occupation said premises and such
compensation shall be paid by the Licensee to the Licensor each and every month
regularly.
3. That it is agreed by and between the parties that the monthly electricity
charges, water charges to such concerned authorities for peaceful enjoyment of
the said room premises as mere Licensee.
4. The Licensee shall not let or sub/let the said premises to any person or
persons during the tenure of this agreement and the Licensee shall be merely
Licensee only for a temporary period of eleven months and the Licensee
undertake She shall not make any alterations, and/or Additions in the said
room premises without the prior consent of the Licensor in writing.
5. The Licensee shall not claim any right, title and/or interest over the said
room premises during the tenure of this agreement. It is further agreed by
and between the parties that the Licensee shall not claim any tenancy and/or
sub/tenancy right over the said room premises, during the tenure of this
agreement.
6. The Licensee shall not allow to use the said Room premises to any third
party or person or will not part with the said premises with any
person or persons during the period of this agreement.
7. The Licensee shall not use the said Room for any immoral, illegal unlawful,
unsocial purposes but shall use only for her residential purpose for herself
and her family members only like a prudent person and the Licensee shall
maintain the said Room premises in good and proper condition during the
tenure of this agreement at her own costs.
8. It is a agreed by the between the parties that the parties that Licensee have
agreed to handover the vacant and physical possession of the said premises
immediately on payment of any arrear bill amount, due and payable by the
Licensee to such concerned authorities, without any excuse and/or hindrance
of whatsoever nature.
9. The Licensee hereby under take she shall observe all rules regulations
any bye-laws of the said society and Municipal and other local authorities
during the tenure of this agreement.
10. This agreement shall be terminated by giving one months prior notice from
the either side by showing the intention to do so.
11. It is further declared that this agreement is executed by the parties herein
under section 24 of the Maharashtra Rents Controls Act. 1999, (the Act), and
the said License further undertakes to honour the provisions of Section 24 of
the Act and the terms and conditions of this Agreement.
IN WITNESSES WHEREOF, the parties to this agreement have hereto and
hereunto set and subscribed their respective hands and seals on the day and the
