Positive Law v Natural Law

Positive law
John Austin
It works for the good. Created and enforced by humans. Authority of the
state. “Whatever is pleasing unto the prince has the force if law”.
It has severe drawbacks that allows tyranny to make a decision to
denounce natural law principles and state can impose whatever rules fit
them. For ex- slavery was a grave violation but nonetheless it was
considered legal in many states.
Natural Law
Aquinas
Preloaded tools by god-The basic goods are made fit for each creature-
life, reproduction, education, seek good, live in society, avoid offence and
shun ignorance.. Instinct shows basic good.
Natural law gives a powerful way to criticize the way in which the
particular system operates and point out the said dangers of positivism.
Ignorance and emotion leads to people ignoring the commandments of
natural law.
The drawbacks to the theories of natural law is that it is not appealing to
atheists. The “Is-ought” problem is a major hindrance to the natural law
theory.
